Intentional release of fluorinated greenhouse gases is prohibited unless technically necessary for the intended use. Where it is necessary, all technically and economically feasible measures must be taken to prevent release as far as possible, including capturing the gases. Independently of that, all necessary precautions must be taken against unintentional release and leakage must be minimised (Article 4(3)). The same precautionary duty applies during production, storage, transport and transfer, and where the gases arise as a by-product (Article 4(4)). It binds operators and manufacturers of equipment, operators of installations, and companies holding equipment during transport or storage.

Die absichtliche Freisetzung fluorierter Treibhausgase ist verboten, soweit sie für die vorgesehene Verwendung nicht technisch notwendig ist. Ist sie notwendig, sind alle technisch und wirtschaftlich durchführbaren Maßnahmen zu ergreifen, um die Freisetzung so weit wie möglich zu verhindern, einschließlich des Auffangens der Gase. Unabhängig davon sind alle notwendigen Vorkehrungen gegen unbeabsichtigte Freisetzung zu treffen und Leckagen auf ein Mindestmaß zu begrenzen (Artikel 4 Absatz 3). Dieselbe Vorkehrungspflicht gilt bei Herstellung, Lagerung, Beförderung und Umfüllung sowie dann, wenn die Gase als Nebenprodukt entstehen (Artikel 4 Absatz 4). Verpflichtet sind Betreiber und Hersteller von Einrichtungen, Betreiber von Anlagen sowie Unternehmen, in deren Besitz sich Einrichtungen während Beförderung oder Lagerung befinden.
