Refrigeration equipment, air-conditioning equipment, heat pumps and metered dose inhalers pre-charged with Annex I group 1 substances may be placed on the market only where the charge is accounted for under the quota system; for metered dose inhalers this has applied since 1 January 2025. Manufacturers and importers fully document compliance, issue a declaration of conformity, thereby assume responsibility for compliance, and keep the documents and the declaration for at least five years from placing on the market. Where the gases contained were not placed on the market before charging, importers have the accuracy of the documents, the declaration of conformity and the report under Article 26(7) verified by an independent auditor registered in the F-gas Portal by 30 April 2025 and annually thereafter. Importers without an establishment in the Union appoint an only representative established in the Union. Undertakings below 10 tonnes CO2 equivalent per year are exempt.

Kälteanlagen, Klimaanlagen, Wärmepumpen und Dosier-Aerosole, die mit Stoffen des Anhangs I Gruppe 1 vorbefüllt sind, dürfen nur in Verkehr gebracht werden, wenn die Füllung im Quotensystem berücksichtigt ist; für Dosier-Aerosole gilt das seit dem 1. Januar 2025. Hersteller und Einführer dokumentieren die Einhaltung vollständig, stellen eine Konformitätserklärung aus, übernehmen damit die Verantwortung für die Einhaltung und bewahren Unterlagen und Erklärung ab dem Inverkehrbringen mindestens fünf Jahre auf. Waren die enthaltenen Gase vor der Befüllung nicht in Verkehr gebracht, lassen Einführer bis zum 30. April 2025 und danach jährlich die Richtigkeit der Unterlagen, der Konformitätserklärung und des Berichts nach Artikel 26 Absatz 7 von einem im F-Gas-Portal registrierten unabhängigen Prüfer bestätigen. Einführer ohne Niederlassung in der Union bestellen einen Alleinvertreter mit Niederlassung in der Union. Unternehmen unter 10 Tonnen CO₂-Äquivalent im Jahr sind ausgenommen.
