Equipment and products falling under Annex IV points 2(b), 4, 5(c), 7(b), (c) and (d), 8(b) to (e), 9(b) to (f), 11(c), 17(c) and 19(b) may no longer be commissioned or used after the respective date of the ban. Commissioning remains permitted where the operator demonstrates that site safety requirements do not allow equipment with a lower global warming potential, or that the goods were placed on the market before the date of the ban. The supporting documents must be kept for at least five years under Article 13(20) and made available to the competent authority or the Commission on request. In Germany the infringement is a criminal offence under Section 12 no. 8 of the Chemicals Sanctions Ordinance, and the failure to retain the evidence an administrative offence under Section 13(2) no. 7.

Einrichtungen und Erzeugnisse, die unter Anhang IV Nummer 2 Buchstabe b, Nummer 4, Nummer 5 Buchstabe c, Nummer 7 Buchstaben b, c und d, Nummer 8 Buchstaben b bis e, Nummer 9 Buchstaben b bis f, Nummer 11 Buchstabe c, Nummer 17 Buchstabe c und Nummer 19 Buchstabe b fallen, dürfen nach dem jeweiligen Verbotszeitpunkt nicht mehr in Betrieb genommen oder verwendet werden. Zulässig bleibt die Inbetriebnahme, wenn der Betreiber nachweist, dass die Sicherheitsanforderungen am Standort eine Einrichtung mit niedrigerem Treibhauspotenzial nicht erlauben oder dass die Ware vor dem Verbotszeitpunkt in Verkehr gebracht wurde. Die Unterlagen zu diesem Nachweis sind nach Artikel 13 Absatz 20 mindestens fünf Jahre aufzubewahren und der zuständigen Behörde oder der Kommission auf Verlangen vorzulegen. In Deutschland ist der Verstoß nach § 12 Nummer 8 der Chemikalien-Sanktionsverordnung eine Straftat, die fehlende Aufbewahrung nach § 13 Absatz 2 Nummer 7 eine Ordnungswidrigkeit.
