The Regulation entered into force on the twentieth day following its publication in the Official Journal of 20 February 2024. Individual provisions apply later, and the Annex IV bans are staggered over more than a decade.
The labelling duties in Article 12 and the quota allocation under Article 17(5) apply only from this date.
From this date the use of fluorinated greenhouse gases with a GWP of 2 500 or more for the servicing or maintenance of refrigeration equipment of any kind is banned; before, the ban applied only from a charge of 40 tonnes CO2 equivalent.
From this date building owners and contractors must ensure that fluorinated greenhouse gases in foams are destroyed during renovation, refurbishment and demolition work.
Annex IV prohibition step of 1 January 2025 — among others self-contained refrigeration equipment with a GWP of 150 or more, refrigeration equipment with a GWP of 2 500 or more, single-split systems below 3 kg with a GWP of 750 or more, fire protection equipment containing Annex I gases, and personal care products.
The provisions on the F-gas Portal and on trade controls at release for free circulation apply from this date.
From this date the export of certain foams, technical aerosols and stationary refrigeration, air-conditioning and heat pump equipment with a GWP of 1 000 or more is banned.
From this date the use of Annex I fluorinated greenhouse gases with a GWP of 2 500 or more for the servicing or maintenance of air-conditioning equipment and heat pumps is banned.
First step of the commissioning ban: medium-voltage primary and secondary distribution switchgear up to and including 24 kV.
Annex IV prohibition step of 1 January 2027 — chillers up to 12 kW with a GWP of 150 or more and above 12 kW with a GWP of 750 or more, self-contained air-conditioning and heat pumps up to 50 kW with a GWP of 150 or more, and air-to-water split systems up to 12 kW.
From this day the recovery duty in Article 8(1) also applies to the operators of the mobile equipment in Article 8(3)(b) and (c). For the leak check under Article 5, by contrast, paragraph 5 names 12 March 2027 as the last day of the exemption, so it starts only on 13 March 2027.
From this day the leak check and the check intervals also apply to the operators of the mobile equipment in Article 5(3)(b) and (c). Article 5(5) exempts them "until 12 March 2027", so application starts on the following day.
Second step of the commissioning ban: high-voltage switchgear above 52 kV up to and including 145 kV with a short-circuit current up to and including 50 kA and a GWP of 1 or more.
Third step of the commissioning ban: medium-voltage switchgear above 24 kV up to and including 52 kV.
Annex IV prohibition step of 1 January 2030 — refrigeration equipment with a GWP of 150 or more, other self-contained air-conditioning and heat pumps with a GWP of 150 or more, and technical aerosols containing fluorinated greenhouse gases.
From this date the use of Annex I fluorinated greenhouse gases with a GWP of 750 or more for the servicing or maintenance of stationary refrigeration equipment other than chillers is banned.
Fourth step of the commissioning ban: high-voltage switchgear above 145 kV or with a short-circuit current above 50 kA and a GWP of 1 or more.
From this date SF6 may be used for the servicing or maintenance of electrical switchgear only if it has been reclaimed or recycled.
Final Annex IV prohibition step: split systems with a rated capacity up to and including 12 kW containing or requiring fluorinated greenhouse gases may no longer be placed on the market.
From this year the maximum quantity of hydrofluorocarbons that may be placed on the Union market is zero.
