Description (English)
Owners of a residential building and owners of a non-residential building heated by its intended use to at least 19 degrees Celsius for at least four months a year must ensure that top storey ceilings not meeting the minimum thermal insulation requirements of DIN 4108-2 are insulated so that the thermal transmittance does not exceed 0.24 watts per square metre and kelvin. The obligation is deemed met where the roof above is insulated accordingly instead, or already meets the minimum thermal insulation requirements. Variants: where the insulation is placed within ceiling cavities and its thickness is technically limited, the requirement is deemed met if the greatest possible thickness under the recognised rules of technology is installed, with a design thermal conductivity of 0.035 W/(m·K), or 0.045 W/(m·K) for blown-in insulation or insulation from renewable raw materials. The same applies to insulation between rafters. For a residential building with no more than two dwellings, one of which the owner occupied on 1 February 2002, the duty falls on the new owner only after a change of ownership, with a two-year deadline; it lapses where the expenditure cannot be recovered within a reasonable period. Eigentümer eines Wohngebäudes sowie Eigentümer eines Nichtwohngebäudes, das nach seiner Zweckbestimmung jährlich mindestens vier Monate auf Innentemperaturen von mindestens 19 Grad Celsius beheizt wird, müssen dafür sorgen, dass oberste Geschossdecken, die nicht den Anforderungen an den Mindestwärmeschutz nach DIN 4108-2 genügen, so gedämmt sind, dass der Wärmedurchgangskoeffizient 0,24 Watt pro Quadratmeter und Kelvin nicht überschreitet. Die Pflicht gilt als erfüllt, wenn anstelle der obersten Geschossdecke das darüber liegende Dach entsprechend gedämmt ist oder den Anforderungen an den Mindestwärmeschutz genügt. Varianten: Wird die Dämmung in Deckenzwischenräumen ausgeführt und ist die Dämmschichtdicke technisch begrenzt, gilt die Anforderung als erfüllt, wenn die nach anerkannten Regeln der Technik höchstmögliche Dämmschichtdicke eingebaut wird; dabei ist ein Bemessungswert der Wärmeleitfähigkeit von 0,035 W/(m·K) einzuhalten, bei eingeblasenen Dämmstoffen oder Dämmstoffen aus nachwachsenden Rohstoffen 0,045 W/(m·K). Entsprechendes gilt für eine Zwischensparrendämmung. Bei einem Wohngebäude mit höchstens zwei Wohnungen, von denen der Eigentümer eine am 1. Februar 2002 selbst bewohnt hat, trifft die Pflicht erst den neuen Eigentümer nach einem Eigentümerwechsel, mit einer Frist von zwei Jahren; sie entfällt, soweit die Aufwendungen sich nicht innerhalb angemessener Frist erwirtschaften lassen.
