Description (English)
Where a heating system in an existing building or building network is replaced and the owner opts for one of the options listed in Section 42(2) or a combination of them, the requirements of Sections 43 to 46 must be observed. The options are: a heating system fired with gas, heating oil or LPG, an electrically driven heat pump, a solar thermal system, a heating system using biomass or green, blue, orange or turquoise hydrogen including derivatives, a heat pump hybrid system, a solar thermal hybrid system, a high-efficiency CHP unit, direct electric heating, a house transfer station for connection to a heat network, or another innovative heating solution. The requirements per option: for a solar thermal system using liquids as heat transfer medium, the collectors or the system must be certified with the European "Solar Keymark" test mark under the recognised rules of technology as long as CE marking is not mandatory (Section 44). Where a combustion plant within the meaning of the Ordinance on small and medium combustion plants is installed, the building owner must ensure that use takes place in a water-based biomass stove or a biomass boiler and that only the biomass listed there is used (Section 45). Direct electric heating may be installed in an existing building with dwellings only where the building undercuts the structural thermal insulation requirements of Sections 16 and 19 by at least 30 %; this does not apply when replacing existing single-room direct electric heating (Section 46). The requirement of Section 42(1) does not apply to buildings of the Federation, allied forces or a company with federal participation serving national and alliance defence. The staggered minimum share of climate-neutral fuels under Section 43(1) is recorded as four separate obligations because of its own dates. Further references: Sections 42, 42a, 44, 45, 46, 107.
Description (German)
Wird eine Heizungsanlage in einem bestehenden Gebäude oder Gebäudenetz ersetzt und entscheidet sich der Eigentümer für eine der in § 42 Absatz 2 genannten Optionen oder für eine Kombination daraus, sind die Maßgaben der §§ 43 bis 46 zu beachten. Zur Wahl stehen: eine mit Gas, Heizöl oder Flüssiggas beschickte Heizungsanlage, eine elektrisch angetriebene Wärmepumpe, eine solarthermische Anlage, eine Heizungsanlage zur Nutzung von Biomasse oder von grünem, blauem, orangenem oder türkisem Wasserstoff einschließlich Derivaten, eine Wärmepumpen-Hybridheizung, eine Solarthermie-Hybridheizung, eine hocheffiziente KWK-Anlage, eine Stromdirektheizung, eine Hausübergabestation zum Anschluss an ein Wärmenetz oder eine andere innovative Heizungslösung. Die Anforderungen je Option: Bei einer solarthermischen Anlage mit Flüssigkeiten als Wärmeträger müssen die Kollektoren oder das System mit dem europäischen Prüfzeichen „Solar Keymark“ nach den anerkannten Regeln der Technik zertifiziert sein, solange keine CE-Kennzeichnung zwingend vorgeschrieben ist (§ 44). Wird eine Feuerungsanlage im Sinne der Verordnung über kleine und mittlere Feuerungsanlagen eingebaut, hat der Gebäudeeigentümer sicherzustellen, dass die Nutzung in einem Biomasseofen mit Wasser als Wärmeträger oder einem Biomassekessel erfolgt und nur die dort genannte Biomasse eingesetzt wird (§ 45). Eine Stromdirektheizung darf in ein bestehendes Gebäude mit Wohnungen nur eingebaut werden, wenn das Gebäude die Anforderungen an den baulichen Wärmeschutz nach den §§ 16 und 19 um mindestens 30 Prozent unterschreitet; beim Austausch einer bestehenden Einzelraum-Stromdirektheizung gilt das nicht (§ 46). Die Anforderung des § 42 Absatz 1 gilt nicht für Gebäude des Bundes, der verbündeten Streitkräfte oder einer Gesellschaft mit Beteiligung des Bundes, die der Landes- und Bündnisverteidigung dienen. Der gestaffelte Mindestanteil klimaneutraler Brennstoffe nach § 43 Absatz 1 ist wegen seiner eigenen Stichtage in vier eigenen Pflichten erfasst. Weitere Fundstellen: §§ 42, 42a, 44, 45, 46, § 107.
