Where a heating system fired with gas, heating oil or LPG is newly installed in an existing building after 29 July 2026, the owner must ensure that from 1. Januar 2040 at least 60 % of the heat supplied by the system is generated from biomethane, bio-oil, biogenic LPG or green, blue, orange or turquoise hydrogen including derivatives. This step is recorded as a separate obligation because one obligation revision can carry only one application date and one rule set; the other steps — 10 % from 2029, 15 % from 2030, 30 % from 2035 and 60 % from 2040 — sit alongside it as separate obligations. Compliance options: the obligation may also be met by using a solar thermal system; between 1 January 2029 and 31 December 2034 it is deemed met where the system has at least 0.04 m² of aperture area per square metre of useful floor area in residential buildings with up to two dwellings and at least 0.03 m² in residential buildings with more than two dwellings. It may equally be met by a ventilation system with heat recovery where the heat recovery rate is at least 73 %, the coefficient of performance at least 10 and the system serves the entire floor area of the building. For a heat pump hybrid system the requirement is deemed met where the heat pump reaches at least 30 % of the peak load generator output at part load point A under DIN EN 14825, or at least 40 % in bivalent alternative operation. Anyone claiming a higher credited share must evidence it through an expert under Section 88 or a contractor declaration. Where biomethane or biogenic LPG is used, the requirements of Section 22(1), sentence 2, points 2 and 3 apply. Transitional rule: where the system is installed between 1 January 2028 and 31 December 2028 because of an irreparable failure of the existing heating, the obligation applies only twelve months after installation; from 1 January 2029 an obligation existing at the time of failure continues for twelve months. Wird eine Heizungsanlage, die mit Gas, Heizöl oder Flüssiggas beschickt wird, nach dem 29. Juli 2026 in ein bestehendes Gebäude neu eingebaut, hat der Eigentümer sicherzustellen, dass ab dem 1. Januar 2040 mindestens 60 Prozent der mit der Anlage bereitgestellten Wärme aus Biomethan, Bioöl, biogenem Flüssiggas oder grünem, blauem, orangenem oder türkisem Wasserstoff einschließlich daraus hergestellter Derivate erzeugt wird. Diese Stufe ist als eigene Pflicht erfasst, weil eine Pflichtfassung nur einen Anwendungsbeginn und ein Regelwerk tragen kann; die übrigen Stufen — 10 Prozent ab 2029, 15 Prozent ab 2030, 30 Prozent ab 2035 und 60 Prozent ab 2040 — stehen als eigene Pflichten daneben. Erfüllungsoptionen: Die Pflicht kann auch durch die Nutzung einer solarthermischen Anlage erfüllt werden; im Zeitraum vom 1. Januar 2029 bis zum 31. Dezember 2034 gilt sie als erfüllt, wenn die Anlage bei Wohngebäuden mit höchstens zwei Wohnungen mindestens 0,04 und bei Wohngebäuden mit mehr als zwei Wohnungen mindestens 0,03 Quadratmeter Aperturfläche je Quadratmeter Nutzfläche hat. Ebenso kann sie durch eine raumlufttechnische Anlage mit Wärmerückgewinnung erfüllt werden, wenn der Wärmerückgewinnungsgrad mindestens 73 Prozent, die Leistungszahl mindestens 10 beträgt und die Anlage die gesamte Gebäudefläche versorgt. Bei einer Wärmepumpen-Hybridheizung gilt die Anforderung als erfüllt, wenn die Wärmepumpe beim Teillastpunkt A nach DIN EN 14825 mindestens 30 Prozent oder bei bivalent alternativem Betrieb mindestens 40 Prozent der Leistung des Spitzenlasterzeugers erreicht. Wer einen höheren Anrechnungsanteil geltend macht, hat ihn durch eine fachkundige Person nach § 88 oder eine Unternehmererklärung nachzuweisen. Bei Nutzung von Biomethan oder biogenem Flüssiggas sind die Anforderungen des § 22 Absatz 1 Satz 2 Nummer 2 bzw. 3 einzuhalten. Übergangsregelung: Wird die Anlage wegen eines irreparablen Ausfalls der bestehenden Heizung zwischen dem 1. Januar 2028 und dem 31. Dezember 2028 eingebaut, gilt die Pflicht erst zwölf Monate nach dem Einbau; ab dem 1. Januar 2029 gilt eine zum Ausfallzeitpunkt bestehende Pflicht zwölf Monate fort. Ist der Eigentümer nicht der Betreiber der Heizungsanlage, ist die Pflicht durch den Betreiber zu erfüllen. Weitere Fundstellen: § 43 Absätze 1 bis 7, § 22 Absatz 1, § 42a.
