Description (English)
A non-residential building with a rated output above 70 kilowatts for a heating system, a combined space heating and ventilation system, an air conditioning system or a combined air conditioning and ventilation system must be equipped by the end of 31 December 2029 with a building automation and control system, unless that is technically impossible or economically unreasonable. The system must continuously monitor, log and analyse the consumption of all main energy carriers and all technical building systems and allow it to be adjusted, make the collected data accessible through a common and freely configurable interface independently of any company or manufacturer, set requirement values for the building’s energy efficiency, detect losses of efficiency, inform the operator about possible improvements and monitor indoor environmental quality. By the same date an automatic lighting control must also be installed; it should be appropriately zoned and have occupancy detection. New-build frame of reference: a non-residential building to be constructed must in addition have a system at least at automation level B of DIN/TS 18599-11 for systems above 290 kilowatts and at least at level C for systems above 70 kilowatts, and must undergo technical commissioning management including adjustment covering at least one heating period and at least one cooling period. Transitional rule: where a system not meeting the requirements was installed in an existing non-residential building within three years before 1 January 2027, the retrofit may take place after 31 December 2029, with a ten-year deadline. Buildings of the Federation, allied forces or a company with federal participation serving national and alliance defence are exempt. Further references: Section 56(1) to (6), Section 74(3), point 1.

Ein Nichtwohngebäude mit einer Nennleistung einer Heizungsanlage, einer kombinierten Raumheizungs- und Lüftungsanlage, einer Klimaanlage oder einer kombinierten Klima- und Lüftungsanlage von mehr als 70 Kilowatt muss bis zum Ablauf des 31. Dezember 2029 mit einem System für die Gebäudeautomatisierung und Gebäudesteuerung ausgerüstet werden, es sei denn, die Ausrüstung ist technisch nicht möglich oder wirtschaftlich unzumutbar. Das System muss den Verbrauch aller Hauptenergieträger und aller gebäudetechnischen Systeme kontinuierlich überwachen, protokollieren und analysieren und dessen Anpassung ermöglichen, die erhobenen Daten über eine gängige und frei konfigurierbare Schnittstelle firmen- und herstellerunabhängig zugänglich machen, Anforderungswerte zur Energieeffizienz aufstellen, Effizienzverluste erkennen, den Betreiber über mögliche Verbesserungen informieren und die Raumklimaqualität überwachen. Bis zum selben Zeitpunkt ist zusätzlich eine automatische Beleuchtungssteuerung einzubauen; sie soll angemessen zoniert sein und über eine Belegungserkennung verfügen. Bezugsrahmen Neubau: Ein zu errichtendes Nichtwohngebäude muss darüber hinaus ein System mindestens nach Automationsgrad B der DIN/TS 18599-11 bei Anlagen über 290 Kilowatt und mindestens nach Automationsgrad C bei Anlagen über 70 Kilowatt haben und ein technisches Inbetriebnahme-Management einschließlich Einregelung durchlaufen, das mindestens eine Heizperiode und mindestens eine Kühlperiode erfasst. Übergangsregelung: Wurde in ein bestehendes Nichtwohngebäude innerhalb von drei Jahren vor dem 1. Januar 2027 ein System eingebaut, das den Anforderungen nicht entspricht, darf die Nachrüstung nach dem 31. Dezember 2029 erfolgen; die Frist beträgt dann zehn Jahre. Gebäude des Bundes, der verbündeten Streitkräfte oder einer Gesellschaft mit Beteiligung des Bundes, die der Landes- und Bündnisverteidigung dienen, sind ausgenommen.
