Description (English)
With the version of Section 76 in force from 1 January 2027 the inspection cycle is staggered by output. For air conditioning systems and combined air conditioning and ventilation systems with a rated cooling output above 12 and up to 70 kilowatts the ten-year cycle remains: the first inspection takes place in the tenth year after commissioning or after the renewal of essential components and is then repeated every ten years. Systems above 70 kilowatts and ventilation systems above 70 kilowatts follow a five-year cycle, recorded as a separate obligation because one obligation revision can carry only one frequency. Transitional rule: systems above 12 kilowatts that were more than ten years old on 1 October 2023 must be inspected for the first time by the end of 31 December 2028. The inspection covers measures to examine the components affecting the efficiency of the system and the sizing of the system in relation to the cooling demand of the building; it relates in particular to the examination and assessment of the factors determining the design — changes in room use and occupancy, operating times, internal heat sources, building physics properties and the set points required by the operator — and to establishing the efficiency of the essential components. Systems above 70 kilowatts must be inspected under DIN SPEC 15240. Compliance option: an operator of more than ten similar systems between 12 and 70 kilowatts in comparable non-residential buildings may meet the obligation through a sample inspection under Section 75(4). A non-residential building is comparable where it was built to the same plan drawn up for several buildings at different sites; systems are similar where they have the same design, function and cooling output per square metre of net floor area. For branch networks this option is the most relevant in practice. Exemptions: for non-residential buildings the obligation lapses where the building is equipped with a building automation and control system or — where the overall impact is equivalent — where the system falls under an energy performance contract or is operated by a utility or network operator. For residential buildings it lapses where the building has continuous electronic monitoring and an effective control function. Mit der ab 1. Januar 2027 geltenden Fassung des § 76 wird der Inspektionsturnus nach der Leistung gestaffelt. Für Klimaanlagen und kombinierte Klima- und Lüftungsanlagen mit einer Nennleistung für den Kältebedarf von mehr als 12 und bis zu 70 Kilowatt bleibt es beim Zehnjahresturnus: Die Inspektion ist erstmals im zehnten Jahr nach der Inbetriebnahme oder der Erneuerung wesentlicher Bauteile durchzuführen und danach alle zehn Jahre zu wiederholen. Für Anlagen über 70 Kilowatt und für Lüftungsanlagen über 70 Kilowatt gilt ein Fünfjahresturnus; er ist als eigene Pflicht erfasst, weil eine Pflichtfassung nur eine Häufigkeit tragen kann. Übergangsregelung: Anlagen über 12 Kilowatt, die am 1. Oktober 2023 mehr als zehn Jahre alt waren, sind bis zum Ablauf des 31. Dezember 2028 erstmals zu inspizieren. Die Inspektion umfasst Maßnahmen zur Prüfung der Komponenten, die den Wirkungsgrad beeinflussen, und der Anlagendimensionierung im Verhältnis zum Kühlbedarf des Gebäudes; sie bezieht sich insbesondere auf die Überprüfung und Bewertung der für die Auslegung maßgeblichen Einflüsse — Veränderungen der Raumnutzung und -belegung, der Nutzungszeiten, der inneren Wärmequellen, der bauphysikalischen Eigenschaften und der vom Betreiber geforderten Sollwerte — und auf die Feststellung der Effizienz der wesentlichen Komponenten. Anlagen über 70 Kilowatt sind nach DIN SPEC 15240 zu inspizieren. Erfüllungsoption: Wer mehr als zehn gleichartige Anlagen zwischen 12 und 70 Kilowatt in vergleichbaren Nichtwohngebäuden betreibt, kann die Pflicht durch eine stichprobenweise Inspektion nach § 75 Absatz 4 erfüllen. Vergleichbar ist ein Nichtwohngebäude, das nach demselben Plan errichtet wurde, der für mehrere Gebäude an verschiedenen Standorten erstellt wurde; gleichartig sind Anlagen gleicher Bauart, Funktion und Kühlleistung je Quadratmeter Nettogrundfläche. Diese Option ist für Filialnetze die praktisch bedeutsamste. Ausnahmen: Bei Nichtwohngebäuden entfällt die Pflicht, wenn das Gebäude mit einem System für Gebäudeautomation und Gebäuderegelung ausgestattet ist oder — bei gleichwertigen Gesamtauswirkungen — wenn die Anlage unter einen Energieleistungsvertrag fällt oder von einem Versorgungsunternehmen oder Netzbetreiber betrieben wird. Bei Wohngebäuden entfällt sie, wenn das Gebäude mit kontinuierlicher elektronischer Überwachung und wirksamer Regelungsfunktion ausgestattet ist. Der Betreiber hat den Inspektionsbericht der zuständigen Behörde auf Verlangen vorzulegen. Weitere Fundstellen: §§ 74 bis 78 in der ab 1. Januar 2027 geltenden Fassung.
