Description (English)
From 1 January 2027 the two types of certificate are called “energy performance certificate based on energy balancing” (Section 81) and “energy performance certificate based on recorded final energy consumption” (Section 82); the former names energy demand certificate and energy consumption certificate are dropped. Where a building is constructed, a certificate based on energy balancing under Section 81 must be issued. The owner must ensure that the certificate is issued without delay after completion and must present it to the competent authority under Land law on request; the same applies to the developer where they are not the owner. Where alterations within the meaning of Section 36 are carried out on an existing building, or a residential building becomes a non-residential building through alterations, a certificate under Section 81 must be issued where calculations are performed for the whole building. On sale, heritable building right, letting, leasing or financial leasing a certificate must be issued unless a valid one already exists; for a non-residential building it must be a certificate based on energy balancing under Section 81. Also new: for an existing non-residential building owned by the public sector and used by an authority, a certificate under Section 81 must always be issued. The certificate must be issued digitally in a machine-readable format and only on request additionally on paper. The certificate rules do not apply to small buildings. Ab dem 1. Januar 2027 heißen die beiden Ausweisarten „Energieausweis auf der Grundlage einer energetischen Bilanzierung“ (§ 81) und „Energieausweis auf der Grundlage des erfassten Endenergieverbrauchs“ (§ 82); die Bezeichnungen Energiebedarfs- und Energieverbrauchsausweis entfallen. Wird ein Gebäude errichtet, ist ein Energieausweis auf der Grundlage einer energetischen Bilanzierung nach § 81 auszustellen. Der Eigentümer hat sicherzustellen, dass der Ausweis unverzüglich nach Fertigstellung ausgestellt wird, und ihn der nach Landesrecht zuständigen Behörde auf Verlangen vorzulegen; dasselbe gilt für den Bauherrn, wenn er nicht Eigentümer ist. Werden bei einem bestehenden Gebäude Änderungen im Sinne des § 36 ausgeführt oder wird ein Wohngebäude durch Änderungen zu einem Nichtwohngebäude, ist bei Berechnungen für das gesamte Gebäude ein Ausweis nach § 81 auszustellen. Für den Fall von Verkauf, Erbbaurecht, Vermietung, Verpachtung oder Leasing ist ein Energieausweis auszustellen, wenn nicht bereits ein gültiger vorliegt; für ein Nichtwohngebäude muss es dabei ein Ausweis auf der Grundlage einer energetischen Bilanzierung nach § 81 sein. Neu ist außerdem: Für ein bestehendes Nichtwohngebäude im Eigentum der öffentlichen Hand, das von einer Behörde genutzt wird, ist stets ein Ausweis nach § 81 auszustellen. Der Ausweis ist digital in einem maschinenlesbaren Format auszustellen und nur auf Verlangen zusätzlich in Papierform. Auf ein kleines Gebäude sind die Ausweisvorschriften nicht anzuwenden.
