Presentation and handover remain unchanged from 1 January 2027: on sale or creation of a heritable building right the seller or estate agent must present a certificate or a copy to the prospective buyer at the latest during the viewing; clearly visible display during the viewing is sufficient. Where no viewing takes place, the certificate must be presented without delay, at the latest on request. It must be handed over immediately after conclusion of the contract. The same applies to letting, leasing and financial leasing. The display duty changed: the decisive criterion is no longer the floor area threshold of 250 or 500 square metres but the type of building. The owner of an existing public-sector non-residential building used by an authority and with heavy public traffic must display the certificate in a clearly visible place; where a non-public building is used by an authority, the display duty falls on the user. The owner of a non-residential building with heavy public traffic that is not used by an authority must display the certificate as soon as and for as long as one exists. An extract following the template of Section 85(3) is sufficient; where display is required, the certificate may be displayed without the recommendations under Section 84. The mandatory information in property advertisements also changed: the advertisement must state whether the certificate was issued under Section 81 or Section 82, the date of issue, the annual primary energy demand in kilowatt hours per year and square metre of useful floor area, the energy efficiency class, the year of construction and the main energy carriers for heating — uniformly for residential and non-residential buildings. For certificates issued before 1 January 2027, Section 112(3) and (4) continues to apply. Vorlage und Übergabe bleiben ab dem 1. Januar 2027 unverändert: Bei Verkauf oder Bestellung eines Erbbaurechts hat der Verkäufer oder der Immobilienmakler dem potenziellen Käufer spätestens bei der Besichtigung einen Energieausweis oder eine Kopie vorzulegen; ein deutlich sichtbarer Aushang oder ein deutlich sichtbares Auslegen während der Besichtigung genügt. Findet keine Besichtigung statt, ist der Ausweis unverzüglich vorzulegen, spätestens auf Aufforderung. Unverzüglich nach Vertragsschluss ist er zu übergeben. Für Vermietung, Verpachtung und Leasing gilt dasselbe. Geändert hat sich der Aushang: Maßgeblich ist nicht mehr die Flächenschwelle von 250 oder 500 Quadratmetern, sondern die Art des Gebäudes. Der Eigentümer eines bestehenden Nichtwohngebäudes im Eigentum der öffentlichen Hand, das von einer Behörde genutzt wird und starken Publikumsverkehr aufweist, hat den Ausweis an gut sichtbarer Stelle auszuhängen; wird ein nicht öffentliches Gebäude behördlich genutzt, trifft die Aushangpflicht den Nutzer. Der Eigentümer eines nicht behördlich genutzten Nichtwohngebäudes mit starkem Publikumsverkehr hat auszuhängen, sobald und solange ein Ausweis vorliegt. Ein Auszug nach dem Muster des § 85 Absatz 3 genügt; ist auszuhängen, darf der Ausweis ohne die Empfehlungen nach § 84 ausgehängt werden. Geändert haben sich auch die Pflichtangaben in der Immobilienanzeige: Anzugeben sind, ob der Ausweis nach § 81 oder § 82 ausgestellt wurde, das Ausstellungsdatum, der Jahres-Primärenergiebedarf in Kilowattstunden pro Jahr und Quadratmeter Nutzfläche, die Energieeffizienzklasse, das Baujahr und die wesentlichen Energieträger für die Heizung — einheitlich für Wohn- und Nichtwohngebäude. Für Ausweise, die vor dem 1. Januar 2027 ausgestellt wurden, gilt § 112 Absätze 3 und 4 fort. Weitere Fundstellen: § 80 Absätze 4 bis 8, § 87, § 112 in der ab 1. Januar 2027 geltenden Fassung, § 108 Absatz 1 Nummern 19, 20 und 22.
