Description (English)
For a building to be constructed, the developer or owner must demonstrate or certify to the authority competent under Land law, by means of a declaration of compliance, that the requirements of this Act are met. The declaration must be submitted after completion of the building unless Land law sets a different point in time; Land law also determines who is entitled to issue it. Where alterations within the meaning of Section 36, sentence 1, are carried out on an existing building and calculations under Section 38(3) are performed for the whole building, a declaration of compliance must be submitted on the basis of the energy characteristics of the altered building; the same applies to extension and conversion under Section 39. The declaration must contain the mandatory information listed in Section 93. Under Section 95 the competent authority may issue the orders necessary to enforce the obligations in individual cases; third parties involved in design, construction or alteration for the developer or owner must comply with such orders directly. Für ein zu errichtendes Gebäude hat der Bauherr oder Eigentümer der nach Landesrecht zuständigen Behörde durch eine Erfüllungserklärung nachzuweisen oder zu bescheinigen, dass die Anforderungen dieses Gesetzes eingehalten werden. Die Erklärung ist nach Fertigstellung des Gebäudes vorzulegen, soweit das Landesrecht keinen anderen Zeitpunkt bestimmt; das Landesrecht bestimmt auch, wer zur Ausstellung berechtigt ist. Werden bei einem bestehenden Gebäude Änderungen im Sinne des § 36 Satz 1 ausgeführt und dabei für das gesamte Gebäude Berechnungen nach § 38 Absatz 3 durchgeführt, ist eine Erfüllungserklärung unter Zugrundelegung der energetischen Eigenschaften des geänderten Gebäudes abzugeben; dasselbe gilt in den Fällen der Erweiterung und des Ausbaus nach § 39. Die Erfüllungserklärung muss die in § 93 genannten Pflichtangaben enthalten. Die zuständige Behörde kann nach § 95 im Einzelfall die zur Erfüllung der Verpflichtungen erforderlichen Anordnungen treffen; Dritte, die für Bauherrn oder Eigentümer an Planung, Errichtung oder Änderung beteiligt sind, haben Anordnungen unmittelbar zu befolgen.
