Anyone carrying out works on or in an existing building in the course of business must confirm in writing to the owner, without delay after completion of the works, that the building or system components altered or installed meet the requirements of the Act (contractor declaration). This covers, among other things, the alteration of external building elements under Section 36, the insulation of top storey ceilings under Section 35(1), the installation of central heating systems and their fitting with control devices under Sections 61 to 63, the installation of circulation and recirculation pumps under Section 64, the first installation, replacement or insulation of heat distribution and hot water pipes under Section 69 and of cold distribution and chilled water pipes under Section 70, and the installation of air conditioning and ventilation systems. The declaration must also contain the information listed in Section 96(3). This obligation is recorded separately because a different party performs it: it is addressed to the contractor, not to the building owner. Wer geschäftsmäßig an oder in einem bestehenden Gebäude Arbeiten durchführt, hat dem Eigentümer unverzüglich nach Abschluss der Arbeiten schriftlich zu bestätigen, dass die geänderten oder eingebauten Bau- oder Anlagenteile den Anforderungen des Gesetzes entsprechen (Unternehmererklärung). Erfasst sind unter anderem die Änderung von Außenbauteilen nach § 36, die Dämmung oberster Geschossdecken nach § 35 Absatz 1, der Einbau von Zentralheizungen und deren Ausstattung mit Regelungseinrichtungen nach den §§ 61 bis 63, der Einbau von Umwälz- und Zirkulationspumpen nach § 64, der erstmalige Einbau, der Ersatz oder die Wärmedämmung von Wärmeverteilungs- und Warmwasserleitungen nach § 69 sowie von Kälteverteilungs- und Kaltwasserleitungen nach § 70 und der Einbau von Klima- und raumlufttechnischen Anlagen. In der Erklärung sind zusätzlich die in § 96 Absatz 3 genannten Angaben zu machen. Diese Pflicht ist getrennt erfasst, weil sie einen anderen Verpflichteten trifft: Sie richtet sich an das ausführende Unternehmen, nicht an den Gebäudeeigentümer.
