Description (English)
The owner must retain the contractor declaration for at least ten years as evidence of compliance with the obligations under the provisions listed in Section 96(1) and present it to the authority competent under Land law on request. The same duty to present applies to the owner for the energy performance certificate under Section 80(1), sentence 4, and to the operator for the inspection report on air conditioning systems under Section 78(4). In addition, the authorised district chimney sweep checks during the fireplace inspection whether heat distribution and hot water pipes that had to be insulated under Section 69 remain uninsulated and whether the statements and confirmations under Section 96(5) are available. Energy performance certificates and inspection reports are also subject to sample checks by the competent authority under Section 99, in the course of which further documents may be requested. Die Unternehmererklärung ist vom Eigentümer zum Nachweis der Erfüllung der Pflichten aus den in § 96 Absatz 1 genannten Vorschriften mindestens zehn Jahre aufzubewahren und der nach Landesrecht zuständigen Behörde auf Verlangen vorzulegen. Dieselbe Vorlagepflicht trifft den Eigentümer für den Energieausweis nach § 80 Absatz 1 Satz 4 und den Betreiber für den Inspektionsbericht über Klimaanlagen nach § 78 Absatz 4. Flankierend prüft der bevollmächtigte Bezirksschornsteinfeger im Rahmen der Feuerstättenschau, ob Wärmeverteilungs- und Warmwasserleitungen, die nach § 69 zu dämmen waren, weiterhin ungedämmt sind und ob die Abrechnungen und Bestätigungen nach § 96 Absatz 5 vorliegen. Energieausweise und Inspektionsberichte unterliegen außerdem der Stichprobenkontrolle der zuständigen Behörde nach § 99; dabei können weitere Unterlagen angefordert werden.
