Description (English)
A building to be constructed must be designed so that its potential for generating solar energy, based on the solar radiation at the site, is optimised, in order to allow solar technologies to be installed cost-effectively. The requirement is met in the design stage and applies irrespective of whether the building is already subject to the duty to install a solar energy installation. Exemptions: the requirement does not apply where measures to limit the total energy performance of an existing non-residential building have to be taken for the building, nor to buildings owned by the Federation, by allied forces or by a company with federal participation that serve national and alliance defence. The Länder may impose stricter requirements on the installation of solar energy installations. Further references: Section 106(3) to (5) as in force from 1 January 2027.

Ein zu errichtendes Gebäude ist so zu konzipieren, dass sein Potenzial zur Erzeugung von Solarenergie auf der Grundlage der Sonneneinstrahlung am Standort optimiert wird, um die kosteneffiziente Installation von Solartechnologien zu ermöglichen. Die Anforderung ist in der Planung zu erfüllen, unabhängig davon, ob für das Gebäude bereits eine Pflicht zur Errichtung einer Solarenergieanlage besteht. Ausnahmen: Die Anforderung entfällt, wenn für das Gebäude Maßnahmen zur Begrenzung der Gesamtenergieeffizienz eines bestehenden Nichtwohngebäudes zu ergreifen sind, sowie für Gebäude im Eigentum des Bundes, der verbündeten Streitkräfte oder einer Gesellschaft mit Beteiligung des Bundes, die der Landes- und Bündnisverteidigung dienen. Die Länder können durch Landesrecht weitergehende Anforderungen an die Errichtung von Solarenergieanlagen stellen. Weitere Fundstellen: § 106 Absätze 3 bis 5 in der ab 1. Januar 2027 geltenden Fassung.
