Description (English)
A solar energy installation must be installed on an existing public non-residential building. The group of buildings concerned widens in three stages, each of which supersedes the previous one: - from 1 January 2028 on an existing public non-residential building with more than 2 000 square metres of useful floor area; - from 1 January 2029 on an existing public non-residential building with more than 750 square metres of useful floor area; - from 1 January 2031 on an existing public non-residential building with more than 250 square metres of useful floor area. Because each stage supersedes the previous one, no single rule set is attached to this obligation; the group of addressees is described here instead. The useful floor area threshold is therefore not available as a filter. The solar obligation for non-residential buildings to be constructed (from 1 January 2027), for existing non-residential buildings with more than 500 square metres of useful floor area undergoing alterations within the meaning of Section 36 (from 1 January 2028) and for new residential buildings and new roofed car parks (from 1 January 2030) is covered by separate obligations, each with its own rule set. The duty does not apply where installing a solar energy installation is technically impossible, functionally not feasible or economically unreasonable, or where it conflicts with other public-law provisions; nor where measures under Section 40(1) have to be taken for the building; nor to buildings serving national and alliance defence. The Länder may impose stricter requirements. Further references: Section 106(2) to (5) as in force from 1 January 2027.
Description (German)
Auf einem bestehenden öffentlichen Nichtwohngebäude ist eine Solarenergieanlage zu errichten. Der Adressatenkreis wächst in drei Stufen, von denen jede die vorangegangene ablöst: - ab dem 1. Januar 2028 auf einem bestehenden öffentlichen Nichtwohngebäude mit einer Nutzfläche von mehr als 2 000 Quadratmetern; - ab dem 1. Januar 2029 auf einem bestehenden öffentlichen Nichtwohngebäude mit einer Nutzfläche von mehr als 750 Quadratmetern; - ab dem 1. Januar 2031 auf einem bestehenden öffentlichen Nichtwohngebäude mit einer Nutzfläche von mehr als 250 Quadratmetern. Weil jede Stufe die vorangegangene ablöst, ist dieser Pflicht kein einzelnes Regelwerk zugeordnet; der Adressatenkreis ist stattdessen hier beschrieben. Die Flächenschwelle steht deshalb nicht als Filter zur Verfügung. Die Solarpflicht für zu errichtende Nichtwohngebäude (ab dem 1. Januar 2027), für bestehende Nichtwohngebäude mit mehr als 500 Quadratmetern Nutzfläche bei Änderungen im Sinne des § 36 (ab dem 1. Januar 2028) sowie für neue Wohngebäude und neue überdachte Parkplätze (ab dem 1. Januar 2030) ist in eigenen Pflichten mit jeweils eigenem Regelwerk erfasst. Die Pflicht entfällt, soweit die Errichtung einer Solarenergieanlage technisch unmöglich, funktional nicht realisierbar oder wirtschaftlich unzumutbar ist oder anderen öffentlich-rechtlichen Vorschriften widerspricht; ferner, wenn für das Gebäude Maßnahmen nach § 40 Absatz 1 zu ergreifen sind, und für Gebäude, die der Landes- und Bündnisverteidigung dienen. Die Länder können weitergehende Anforderungen stellen. Weitere Fundstellen: § 106 Absätze 2 bis 5 in der ab 1. Januar 2027 geltenden Fassung.
