Description (English)
From 1 January 2030 the owner of an existing non-residential building must ensure by suitable measures that the annual primary energy demand for heating, hot water, ventilation, cooling and built-in lighting does not exceed 3.5 times that of a reference building with the same geometry, useful floor area, orientation and use built to the technical reference design of Annex 2; a primary energy factor of 0.7 is always used for the reference building. The requirement is deemed to be met where the building was constructed on or after 1 January 1996, where the owner shows that a building constructed earlier was brought to the level of the 1994 Thermal Insulation Ordinance, where the heating system generates heat mainly from biomass or a heat pump, or where the building is supplied with district heat. It does not apply where compliance is technically impossible or economically unreasonable or conflicts with other public-law provisions, nor to listed monuments or particularly protected building fabric, low-energy industrial plants, workshops and agricultural buildings, free-standing small buildings, buildings serving national and alliance defence, or buildings for which demolition, closure of the site, a change of use or a comprehensive refurbishment has been decided. Ab dem 1. Januar 2030 hat der Eigentümer eines bestehenden Nichtwohngebäudes mit geeigneten Maßnahmen dafür zu sorgen, dass der Jahres-Primärenergiebedarf für Heizung, Warmwasserbereitung, Lüftung, Kühlung und eingebaute Beleuchtung das 3,5fache des Jahres-Primärenergiebedarfs eines Referenzgebäudes nicht überschreitet, das die gleiche Geometrie, Nutzfläche, Ausrichtung und Nutzung aufweist und der technischen Referenzausführung der Anlage 2 entspricht; für das Referenzgebäude ist immer der Primärenergiefaktor 0,7 zu verwenden. Die Anforderung gilt als erfüllt, wenn das Nichtwohngebäude ab dem 1. Januar 1996 errichtet wurde, wenn der Eigentümer für ein älteres Gebäude das Anforderungsniveau der Wärmeschutzverordnung von 1994 nachweist, wenn die Heizungsanlage die Wärme überwiegend mit Biomasse oder einer Wärmepumpe erzeugt oder wenn das Gebäude mit Fernwärme versorgt wird. Sie ist nicht anzuwenden, soweit ihre Einhaltung technisch unmöglich oder wirtschaftlich unzumutbar ist oder anderen öffentlich-rechtlichen Vorschriften widerspricht, und ebenso wenig auf Baudenkmäler und besonders erhaltenswerte Bausubstanz, auf Industrieanlagen, Werkstätten und landwirtschaftliche Nutzgebäude mit niedrigem Energiebedarf, auf freistehende kleine Gebäude, auf Gebäude der Landes- und Bündnisverteidigung sowie auf Gebäude, für die Abriss, Betriebsaufgabe, Nutzungsänderung oder umfassende Sanierung feststehen.
