Description (English)
From 1 January 2028 the life-cycle greenhouse gas emissions must be determined for new buildings with more than 1 000 square metres of useful floor area. From 1 January 2030 the duty applies to all new buildings; that second stage is recorded as a separate obligation. The emissions are determined according to the state of the art under Section 7(5) and set out in a life-cycle greenhouse gas balance report. That report is a non-independent part serving the disclosure of the life-cycle greenhouse gas emissions in the energy performance certificate, and must be transmitted to the issuer of that certificate in a machine-readable electronic format. The federal ministry publishes a template for the report and the requirements for the data exchange format in the Federal Gazette. Only a person who has successfully completed continuing education in applied life-cycle assessment for buildings and who is entitled to issue energy performance certificates, is entitled to submit building documents, or is entitled under Land building regulations to prepare such a report may issue it. Ab dem 1. Januar 2028 sind die Lebenszyklus-Treibhausgasemissionen für neu zu errichtende Gebäude mit einer Nutzfläche von mehr als 1 000 Quadratmetern zu ermitteln. Ab dem 1. Januar 2030 gilt die Pflicht für alle neu zu errichtenden Gebäude; diese zweite Stufe ist als eigene Pflicht erfasst. Die Ermittlung erfolgt nach den Regeln der Technik nach § 7 Absatz 5; das Ergebnis ist in einem Bericht zur Treibhausgas-Bilanz im Lebenszyklus auszustellen. Der Bericht ist ein unselbständiger Teil, der der Ausstellung der Lebenszyklus-Treibhausgasemissionen im Energieausweis dient, und ist dem Aussteller des Energieausweises in einem maschinenlesbaren elektronischen Format zu übermitteln. Muster und Datenaustauschformat macht das zuständige Bundesministerium im Bundesanzeiger bekannt. Den Bericht ausstellen darf nur, wer eine Fortbildung im Bereich der angewandten Ökobilanz für Gebäude erfolgreich abgeschlossen hat und zur Ausstellung von Energieausweisen berechtigt, bauvorlageberechtigt oder nach Landesrecht zur Erstellung eines solchen Berichts berechtigt ist. Das Unternehmen hat daher eine berechtigte Person zu beauftragen. Weitere Fundstellen: §§ 88b und 88c in der ab 1.
