Adoption of the Act as Article 1 of the Act of 8 August 2020.
The Act entered into force on 1 November 2020.
The version applicable today entered into force: Article 1 of the Act of 23 July 2026 renamed the Act the Building Modernisation Act and rewrote the rules on heat supply.
Article 2 of the Act of 23 July 2026 enters into force and amends the Act extensively.
From 1 January 2027 a solar energy installation must be built on public non-residential buildings to be constructed and on new non-residential buildings with a useful floor area of more than 250 square metres.
Water-based heating systems installed before 1 October 2009 in buildings with at least six dwellings must undergo a heating check and heating optimisation.
Article 3 of the Act of 23 July 2026 enters into force and inserts Section 10a on zero-emission buildings for new public-sector non-residential buildings.
From 1 January 2028 a solar energy installation must be built on existing public non-residential buildings with more than 2 000 square metres of useful floor area and on existing non-residential buildings with more than 500 square metres where alterations under Section 36 are carried out and calculations under Section 38(3) are performed for the whole building.
From 1 January 2028 life-cycle greenhouse gas emissions must be determined for new buildings with more than 1 000 square metres of useful floor area and set out in a life-cycle greenhouse gas balance report.
First inspection of air conditioning and combined air conditioning and ventilation systems above 12 kW that were more than ten years old on 1 October 2023 (version in force from 1 January 2027).
From 1 January 2029 at least 10 % of the heat supplied by a newly installed gas, heating oil or LPG heating system must come from the fuels listed in Section 43(1).
From 1 January 2029 a solar energy installation must be built on existing public non-residential buildings with more than 750 square metres of useful floor area; the threshold of 2 000 square metres applying since 1 January 2028 is superseded.
Ventilation systems above 70 kW that were more than 20 years old on 1 January 2027 must undergo their first inspection by 1 January 2029. The deadline belongs to the five-yearly inspection obligation for systems above 70 kW.
Non-residential buildings with a system rated output above 70 kW must be equipped with a building automation and control system and with automatic lighting controls.
Article 4 of the Act of 23 July 2026 enters into force: every building to be constructed must then be a zero-emission building.
From 1 January 2030 the share rises to at least 15 %.
From 1 January 2030 a solar energy installation must be built on new residential buildings and on new roofed car parks physically adjacent to a building.
From 1 January 2030 the annual primary energy demand of an existing non-residential building for heating, hot water, ventilation, cooling and built-in lighting must not exceed 3.5 times that of the reference building.
From 1 January 2030 life-cycle greenhouse gas emissions must be determined for all new buildings, irrespective of useful floor area.
From 1 January 2031 a solar energy installation must be built on existing public non-residential buildings with more than 250 square metres of useful floor area; this completes the roll-out of the solar obligation.

From 1 January 2035 the share rises to at least 30 %.
From 1 January 2040 the share rises to at least 60 %.
