Description (English)
Essential entities that infringe Article 21 or 23 are subject to administrative fines of a maximum of at least EUR 10 000 000 or of at least 2 % of the total worldwide annual turnover in the preceding financial year of the undertaking to which the entity belongs, whichever is higher. The reference figure is the turnover of the whole undertaking, not only of the entity concerned. The fine is imposed in addition to the enforcement measures under Article 32(4), points (a) to (h), and Article 32(5); it must be effective, proportionate and dissuasive. Member States may in addition provide for periodic penalty payments to compel an entity to cease an infringement (Article 34(6)). Where the infringement also entails a personal data breach, Article 35(2) provides that no fine under this Directive is imposed to the extent that the data protection supervisory authority has already imposed a fine under Regulation (EU) 2016/679.

Gegen wesentliche Einrichtungen, die gegen Artikel 21 oder 23 verstoßen, werden Geldbußen mit einem Höchstbetrag von mindestens 10 000 000 EUR oder von mindestens 2 % des gesamten weltweiten im vorangegangenen Geschäftsjahr getätigten Umsatzes des Unternehmens, dem die Einrichtung angehört, verhängt — je nachdem, welcher Betrag höher ist. Bezugsgröße ist der Umsatz des gesamten Unternehmens, nicht nur der betroffenen Einrichtung. Die Geldbuße tritt zu den Durchsetzungsmaßnahmen nach Artikel 32 Absatz 4 Buchstaben a bis h und Absatz 5 hinzu; sie muss wirksam, verhältnismäßig und abschreckend sein. Die Mitgliedstaaten können zusätzlich Zwangsgelder vorsehen, um eine Einrichtung zur Beendigung eines Verstoßes zu zwingen (Artikel 34 Absatz 6). Betrifft der Verstoß zugleich eine Verletzung des Schutzes personenbezogener Daten, wird nach Artikel 35 Absatz 2 keine Geldbuße nach dieser Richtlinie verhängt, soweit die Datenschutzaufsichtsbehörde bereits eine Geldbuße nach der Verordnung (EU) 2016/679 verhängt hat.
