Description (English)
Important entities that infringe Article 21 or 23 are subject to administrative fines of a maximum of at least EUR 7 000 000 or of at least 1,4 % of the total worldwide annual turnover in the preceding financial year of the undertaking to which the entity belongs, whichever is higher. Here too the reference figure is the turnover of the whole undertaking. The fine is imposed in addition to the enforcement measures under Article 33(4), points (a) to (g). The suspension of authorisations and the temporary prohibition on exercising managerial functions under Article 32(5) are not available against important entities.

Gegen wichtige Einrichtungen, die gegen Artikel 21 oder 23 verstoßen, werden Geldbußen mit einem Höchstbetrag von mindestens 7 000 000 EUR oder von mindestens 1,4 % des gesamten weltweiten im vorangegangenen Geschäftsjahr getätigten Umsatzes des Unternehmens, dem die Einrichtung angehört, verhängt — je nachdem, welcher Betrag höher ist. Auch hier ist der Umsatz des gesamten Unternehmens die Bezugsgröße. Die Geldbuße tritt zu den Durchsetzungsmaßnahmen nach Artikel 33 Absatz 4 Buchstaben a bis g hinzu. Die Aussetzung von Genehmigungen und das vorübergehende Verbot von Leitungsaufgaben nach Artikel 32 Absatz 5 stehen gegenüber wichtigen Einrichtungen nicht zur Verfügung.
