Description (English)
Where the enforcement measures under Article 32(4), points (a) to (d) and (f), prove ineffective and the essential entity fails to take the required measures within the deadline set, the competent authority may temporarily suspend a certification or authorisation concerning part or all of the relevant services or activities, or request a certification or authorisation body or a court to do so. It may also request that natural persons at managing director or legal representative level be temporarily prohibited from exercising managerial functions in that entity. Suspension and prohibition apply only until the entity has remedied the deficiencies or met the authority's requirements; adequate procedural safeguards must be in place. These measures do not apply to public administration entities.

Bleiben die Durchsetzungsmaßnahmen nach Artikel 32 Absatz 4 Buchstaben a bis d und f wirkungslos und ergreift die wesentliche Einrichtung die geforderten Maßnahmen nicht innerhalb der gesetzten Frist, kann die zuständige Behörde die Zertifizierung oder Genehmigung für einen Teil oder alle einschlägigen Dienste oder Tätigkeiten vorübergehend aussetzen oder eine Zertifizierungs- oder Genehmigungsstelle oder ein Gericht dazu auffordern. Sie kann außerdem verlangen, dass natürlichen Personen auf Geschäftsführungs- bzw. Vorstandsebene oder auf Ebene des rechtlichen Vertreters vorübergehend untersagt wird, Leitungsaufgaben in dieser Einrichtung wahrzunehmen. Aussetzung und Verbot gelten nur so lange, bis die Einrichtung die Mängel behoben oder die Anforderungen der Behörde erfüllt hat; es müssen angemessene Verfahrensgarantien bestehen. Auf Einrichtungen der öffentlichen Verwaltung finden diese Maßnahmen keine Anwendung.
