Description (English)
Members of the management bodies of essential and important entities can be held liable for infringements by the entity of Article 21. In addition, Article 32(6) — applicable to important entities through Article 33(5) — ensures that natural persons responsible for or representing the entity can be held liable for breaching their duty to ensure compliance with the Directive. The concrete form — civil liability, administrative offence or criminal offence — is determined by national transposing law; Article 36 requires Member States to lay down effective, proportionate and dissuasive penalties and to notify them to the Commission by 17 January 2025. For public administration entities national liability rules for public officials remain unaffected.

Die Mitglieder der Leitungsorgane wesentlicher und wichtiger Einrichtungen können für Verstöße der Einrichtung gegen Artikel 21 verantwortlich gemacht werden. Ergänzend stellt Artikel 32 Absatz 6 — über Artikel 33 Absatz 5 auch für wichtige Einrichtungen — sicher, dass natürliche Personen, die für die Einrichtung verantwortlich sind oder sie vertreten, für Verstöße gegen ihre Pflicht zur Gewährleistung der Einhaltung der Richtlinie haftbar gemacht werden können. Die konkrete Ausgestaltung — zivilrechtliche Haftung, Ordnungswidrigkeit oder Straftatbestand — bestimmt das nationale Umsetzungsrecht; Artikel 36 verpflichtet die Mitgliedstaaten, wirksame, verhältnismäßige und abschreckende Sanktionen vorzusehen und sie der Kommission bis zum 17. Januar 2025 mitzuteilen. Für Einrichtungen der öffentlichen Verwaltung bleiben die nationalen Haftungsregelungen für öffentliche Bedienstete und Amtsträger unberührt.
