All packaging placed on the market must be recyclable (Article 6(1)). Packaging is recyclable where it is designed for material recycling and, once waste, can be collected separately, sorted and recycled at scale (Article 6(2)). The company assesses recyclability on the basis of the delegated and implementing acts and expresses it in performance grades A, B or C under Annex II, Table 3; from 2030 only packaging of grade A, B or C may be placed on the market (Article 6(3)). The assessment is made per packaging unit and separately for integrated and separate components (Article 6(9)). Innovative packaging may be made available by way of derogation for five years under Article 6(10) if the competent authority is notified in advance. Article 6(11) exempts, among others, primary packaging of medicinal products, contact-sensitive packaging of medical devices and infant formula.

Alle in Verkehr gebrachten Verpackungen müssen recyclingfähig sein (Artikel 6 Absatz 1). Recyclingfähig ist eine Verpackung, wenn sie für das stoffliche Recycling gestaltet ist und als Abfall getrennt gesammelt, sortiert und in großem Maßstab recycelt werden kann (Artikel 6 Absatz 2). Das Unternehmen bemisst die Recyclingfähigkeit auf Grundlage der delegierten Rechtsakte und Durchführungsrechtsakte und drückt sie in den Leistungsstufen A, B oder C nach Anhang II Tabelle 3 aus; ab 2030 dürfen nur noch Verpackungen der Stufen A, B oder C in Verkehr gebracht werden (Artikel 6 Absatz 3). Die Bewertung erfolgt je Verpackungseinheit und für integrierte wie separate Bestandteile getrennt (Artikel 6 Absatz 9). Innovative Verpackungen dürfen nach Artikel 6 Absatz 10 fünf Jahre lang abweichend bereitgestellt werden, wenn die zuständige Behörde vorab unterrichtet wird. Artikel 6 Absatz 11 nimmt unter anderem Primärverpackungen von Arzneimitteln, kontaktempfindliche Verpackungen von Medizinprodukten und Säuglingsnahrung aus.
