From 1 January 2038, packaging may be placed on the market only if it is recyclable at performance grade A or B under Annex II, Table 3. This tightens the grade C requirement applicable from 2030; grade C packaging may no longer be placed on the market from that date. Annex II, Table 3 assigns grade A an assessment of at least 95 %, grade B at least 80 % and grade C at least 70 %.

Damit verschärft sich die Anforderung gegenüber der ab 2030 geltenden Stufe C; Verpackungen der Stufe C dürfen ab diesem Zeitpunkt nicht mehr in Verkehr gebracht werden. Anhang II Tabelle 3 ordnet der Stufe A eine Bewertung von mindestens 95 %, der Stufe B von mindestens 80 % und der Stufe C von mindestens 70 % zu.
