Environmental claims about packaging characteristics for which the Regulation lays down legal requirements are permitted only where they relate to characteristics that go beyond the applicable minimum requirements and where it is stated whether they relate to the packaging unit, to part of it or to all packaging of the economic operator (Article 14). In addition, under Article 12(8) economic operators may not apply labels, symbols or inscriptions that may mislead or confuse consumers about the sustainability requirements, other packaging characteristics or the waste management options. The duty operates as a limit on voluntary communication: a company that makes no environmental claim is not concerned by Article 14; a company that makes one must satisfy both conditions.

Umweltaussagen zu Verpackungseigenschaften, für die die Verordnung rechtliche Anforderungen festlegt, sind nur zulässig, wenn sie sich auf Eigenschaften beziehen, die über die geltenden Mindestanforderungen hinausgehen, und wenn angegeben wird, ob sie sich auf die Verpackungseinheit, einen Teil davon oder auf alle Verpackungen des Wirtschaftsakteurs beziehen (Artikel 14). Ergänzend dürfen Wirtschaftsakteure nach Artikel 12 Absatz 8 keine Kennzeichnungen, Symbole oder Aufschriften anbringen, die Verbraucher über die Nachhaltigkeitsanforderungen, andere Verpackungsmerkmale oder die Abfallbewirtschaftungsoptionen irreführen oder verwirren können. Die Pflicht wirkt als Grenze der freiwilligen Kommunikation: Wer keine Umweltaussage trifft, ist von Artikel 14 nicht betroffen; wer eine trifft, muss beide Bedingungen erfüllen.
