Before placing packaging on the market, the company carries out or has carried out the conformity assessment procedure under Article 38 and draws up the technical documentation under Annex VII (Article 15(2)). The procedure is Module A — internal production control; under Annex VII, point 2 the technical documentation comprises, among other things, a description of the packaging and its intended use, designs and manufacturing drawings, the list of harmonised standards and common specifications applied, a qualitative description of the assessments under Articles 6, 10 and 11, and test reports. Once conformity is demonstrated, the company issues the EU declaration of conformity under Article 39; it follows the model in Annex VIII, must be kept up to date and, under Article 39(4), establishes the manufacturer’s responsibility for conformity. Where the packaging is subject to several Union acts, Article 39(3) requires a single declaration. Under Article 15(11) the duty does not apply to custom transport packaging for configurable medical devices and systems. Importers ensure, before placing packaging on the market, that the manufacturer has carried out the conformity assessment procedure and drawn up the technical documentation, and keep a copy of the EU declaration of conformity available for the market surveillance authorities.

Vor dem Inverkehrbringen führt das Unternehmen das Konformitätsbewertungsverfahren nach Artikel 38 durch oder lässt es durchführen und erstellt die technische Dokumentation nach Anhang VII (Artikel 15 Absatz 2). Ist die Konformität nachgewiesen, stellt das Unternehmen die EU-Konformitätserklärung nach Artikel 39 aus; sie folgt dem Muster in Anhang VIII, ist stets auf dem neuesten Stand zu halten und begründet nach Artikel 39 Absatz 4 die Verantwortung des Erzeugers für die Konformität. Unterliegt die Verpackung mehreren Unionsrechtsakten, ist nach Artikel 39 Absatz 3 nur eine einzige Erklärung auszustellen. Nach Artikel 15 Absatz 11 gilt die Pflicht nicht für maßgefertigte Transportverpackungen für konfigurierbare Medizinprodukte und -systeme. Importeure stellen vor dem Inverkehrbringen sicher, dass der Erzeuger das Konformitätsbewertungsverfahren durchgeführt und die technische Dokumentation erstellt hat, und halten eine Kopie der EU-Konformitätserklärung für die Marktüberwachungsbehörden bereit.
