Manufacturers and importers place only packaging on the market that complies with the requirements of Articles 5 to 12 (Article 15(1), Article 18(1)). Before placing packaging on the market, the importer verifies that the conformity assessment procedure has been carried out, that the technical documentation exists, that the packaging is labelled under Article 12, that the required documents accompany it and that the manufacturer has provided the information under Article 15(5) and (6) (Article 18(2)). Distributors check before making packaging available whether the producer is entered in the producer register, whether the packaging is labelled and whether manufacturer and importer have provided their information; where in doubt they may not make the packaging available (Article 19(1) to (3)). All operators also ensure that storage and transport conditions do not jeopardise conformity while the packaging is under their responsibility (Article 18(5), Article 19(3) second subparagraph, Article 20). Under Article 19(4) distributors may not misuse information disclosed by the producer for commercial purposes.

Erzeuger und Importeure bringen nur Verpackungen in Verkehr, die den Anforderungen der Artikel 5 bis 12 entsprechen (Artikel 15 Absatz 1, Artikel 18 Absatz 1). Vor dem Inverkehrbringen vergewissert sich der Importeur, dass das Konformitätsbewertungsverfahren durchgeführt wurde, die technische Dokumentation vorliegt, die Verpackung nach Artikel 12 gekennzeichnet ist, die erforderlichen Unterlagen beigefügt sind und der Erzeuger die Angaben nach Artikel 15 Absätze 5 und 6 gemacht hat (Artikel 18 Absatz 2). Vertreiber prüfen vor der Bereitstellung, ob der Hersteller im Herstellerregister eingetragen ist, ob die Verpackung gekennzeichnet ist und ob Erzeuger und Importeur ihre Angaben gemacht haben; bei Zweifeln dürfen sie die Verpackung nicht bereitstellen (Artikel 19 Absätze 1 bis 3). Alle Akteure gewährleisten außerdem, dass Lagerungs- und Transportbedingingungen die Konformität nicht beeinträchtigen, solange die Verpackungen in ihrer Verantwortung sind (Artikel 18 Absatz 5, Artikel 19 Absatz 3 Unterabsatz 2, Artikel 20). Vertreiber dürfen die vom Hersteller offengelegten Informationen nach Artikel 19 Absatz 4 nicht zu gewerblichen Zwecken missbrauchen.
