Where the company has reason to believe that packaging it has placed on the market does not comply with the requirements of Articles 5 to 12, it immediately takes the corrective measures necessary to bring the packaging into conformity, to withdraw it or to recall it, and immediately informs the market surveillance authorities of the Member States in which it made the packaging available of the suspected non-conformity and the measures taken (Article 15(8)). Article 18(6) applies identically to importers and Article 19(5) to distributors. Where there is a risk to the environment or to human health, Article 58(4) additionally requires the economic operator to ensure that appropriate corrective action is taken for all non-compliant packaging made available across the Union. Under Article 15(9) the duty does not apply to reusable packaging placed on the market before 11 February 2025.

Hat das Unternehmen Grund zu der Annahme, dass von ihm in Verkehr gebrachte Verpackungen den Anforderungen der Artikel 5 bis 12 nicht entsprechen, ergreift es unverzüglich die erforderlichen Korrekturmaßnahmen, um die Konformität herzustellen, die Verpackungen gegebenenfalls vom Markt zu nehmen oder zurückzurufen, und unterrichtet unverzüglich die Marktüberwachungsbehörden der Mitgliedstaaten, in denen es die Verpackungen bereitgestellt hat, über die mutmaßliche Nichtkonformität und die ergriffenen Maßnahmen (Artikel 15 Absatz 8). Für Importeure gilt Artikel 18 Absatz 6, für Vertreiber Artikel 19 Absatz 5 wortgleich. Bei einem Risiko für Umwelt oder menschliche Gesundheit gewährleistet der Wirtschaftsakteur nach Artikel 58 Absatz 4 zusätzlich, dass für alle unionsweit bereitgestellten nichtkonformen Verpackungen geeignete Korrekturmaßnahmen ergriffen werden. Für wiederverwendbare Verpackungen, die vor dem 11. Februar 2025 in Verkehr gebracht wurden, gilt die Pflicht nach Artikel 15 Absatz 9 nicht.
