Final distributors operating in the HORECA sector and supplying hot or cold beverages or ready-prepared food in take-away packaging must, by 12 February 2027, provide a system allowing consumers to bring their own container to be filled (Article 32(1)). The products may not be offered at a higher price or on less favourable terms than the sales unit consisting of the same product in single-use packaging. Consumers must be informed of the possibility at the point of sale by clearly visible and legible signs or notices (Article 32(2)).

Endvertreiber, die im Gastgewerbe tätig sind und heiße oder kalte Getränke oder fertig zubereitete Lebensmittel in Verpackungen zum Mitnehmen bereitstellen, sehen bis zum 12. Februar 2027 ein System vor, bei dem die Verbraucher ihr eigenes Behältnis zum Befüllen mitbringen können (Artikel 32 Absatz 1). Die Produkte dürfen dabei zu keinem höheren Preis und nicht zu weniger günstigen Bedingungen angeboten werden als beim Verkauf in einer Einwegverpackung. Auf die Möglichkeit ist an der Verkaufsstelle durch gut sichtbare und lesbare Hinweistafeln oder -schilder hinzuweisen (Artikel 32 Absatz 2).
