Final distributors operating in the HORECA sector and supplying hot or cold beverages or ready-prepared food in take-away packaging must, by 12 February 2028, give consumers the possibility of obtaining the products in reusable packaging within a re-use system (Article 33(1)). Consumers must be informed of the possibility at the point of sale by clearly visible and legible signs or notices (Article 33(2)); the products may not be offered at a higher price or on less favourable terms than in single-use packaging (Article 33(3)). Micro-enterprises are exempt from the article under Article 33(4). From 2030 final distributors are additionally to endeavour to offer 10 % of the products in reusable packaging formats (Article 33(5)).

Endvertreiber, die im Gastgewerbe tätig sind und heiße oder kalte Getränke oder fertig zubereitete Lebensmittel in Verpackungen zum Mitnehmen bereitstellen, räumen bis zum 12. Februar 2028 den Verbrauchern die Möglichkeit ein, die Produkte in einer wiederverwendbaren Verpackung innerhalb eines Wiederverwendungssystems zu erhalten (Artikel 33 Absatz 1). Auf die Möglichkeit ist an der Verkaufsstelle durch gut sichtbare und lesbare Hinweistafeln oder -schilder hinzuweisen (Artikel 33 Absatz 2); die Produkte dürfen nicht teurer oder zu weniger günstigen Bedingungen angeboten werden als in einer Einwegverpackung (Artikel 33 Absatz 3). Kleinstunternehmen sind nach Artikel 33 Absatz 4 von der Anwendung des Artikels ausgenommen. Ab 2030 bemühen sich die Endvertreiber zusätzlich, 10 % der Produkte in wiederverwendbaren Verpackungsformaten anzubieten (Artikel 33 Absatz 5).
