Producers must register in every Member State in which they make packaging or packaged products available for the first time, or unpack packaged products without being the end user; the application is submitted to the authority responsible for the register in the Member State concerned (Article 44(2)). Without registration, packaging or packaged products may not be made available for the first time in that Member State (Article 44(4)). The application contains the information set out in Annex IX Part A; Member States may require further information (Article 44(5)). Where the producer has entrusted a producer responsibility organisation or appointed an authorised representative, they discharge the duty on the producer’s behalf (Article 44(2) and (3)). Changes to the registration data and permanent cessation of first making available must be notified to the authority without delay (Article 44(12)). The authority decides on the application within twelve weeks of receipt of all information and issues a registration number (Article 44(11), point (b)).

Hersteller müssen sich in jedem Mitgliedstaat registrieren, in dem sie Verpackungen oder verpackte Produkte erstmals bereitstellen oder verpackte Produkte auspacken, ohne Endabnehmer zu sein; der Antrag geht an die für das Register zuständige Behörde des jeweiligen Mitgliedstaats (Artikel 44 Absatz 2). Ohne Registrierung dürfen Verpackungen oder verpackte Produkte im betreffenden Mitgliedstaat nicht erstmals bereitgestellt werden (Artikel 44 Absatz 4). Der Antrag enthält die Angaben nach Anhang IX Teil A; die Mitgliedstaaten können weitere Angaben verlangen (Artikel 44 Absatz 5). Hat der Hersteller eine Organisation für Herstellerverantwortung betraut oder einen Bevollmächtigten benannt, erfüllen diese die Pflicht in seinem Namen (Artikel 44 Absätze 2 und 3). Änderungen der Registerangaben und die endgültige Einstellung der erstmaligen Bereitstellung sind der Behörde unverzüglich zu melden (Artikel 44 Absatz 12). Die Behörde entscheidet über den Antrag innerhalb von zwölf Wochen nach Vorlage aller Angaben und erteilt eine Registrierungsnummer (Artikel 44 Absatz 11 Buchstabe b).
