Producers bear extended producer responsibility for the packaging they make available on the territory of a Member State for the first time, or unpack without being the end user (Article 45(1)). Beyond the costs referred to in Article 8a(4), point (a) of Directive 2008/98/EC, the financial contributions cover the costs of labelling waste receptacles under Article 13 and of surveys on the composition of collected mixed municipal waste; the costs must be established in a transparent, proportionate, non-discriminatory and efficient manner (Article 45(2)). Under Article 6(8) the contributions are modulated according to the recyclability performance grades 18 months after the entry into force of the relevant acts; under Article 7(7) they may additionally be modulated by recycled content. Producers not established in the Member State concerned appoint an authorised representative for extended producer responsibility there by written mandate; Member States may extend this to producers established in third countries (Article 45(3)).

Über die Kosten nach Artikel 8a Absatz 4 Buchstabe a der Richtlinie 2008/98/EG hinaus decken die Finanzbeiträge die Kosten für die Kennzeichnung der Abfallbehälter nach Artikel 13 und für Erhebungen über die Zusammensetzung gesammelter gemischter Siedlungsabfälle ab; die Kosten sind transparent, verhältnismäßig, diskriminierungsfrei und effizient festzulegen (Artikel 45 Absatz 2). Nach Artikel 6 Absatz 8 werden die Beiträge 18 Monate nach Inkrafttreten der Rechtsakte zur Recyclingfähigkeit nach den Leistungsstufen moduliert; nach Artikel 7 Absatz 7 können sie zusätzlich nach dem Rezyklatanteil moduliert werden. Hersteller ohne Niederlassung im betreffenden Mitgliedstaat benennen dort mittels schriftlicher Vollmacht einen Bevollmächtigten für die erweiterte Herstellerverantwortung; die Mitgliedstaaten können das auch für Hersteller aus Drittländern vorsehen (Artikel 45 Absatz 3).
