Providers of online platforms allowing consumers to conclude distance contracts with producers obtain from those producers, before allowing them to use their services, the information on registration under Article 44 in the consumer’s Member State, the registration numbers and a self-certification by the producer (Article 45(4)), and make best efforts to assess whether that information is complete and reliable (Article 45(6)). Producers offering packaging or packaged products to consumers in the Union make the same information available to their fulfilment service providers at the time the contract is concluded (Article 45(7)). Fulfilment service providers make best efforts to assess the information received, for instance by consulting freely accessible official databases or the publicly available registration list under Article 44(13); producers remain responsible for the accuracy of the information (Article 45(8)). Where a fulfilment service provider suspends its services, the producer concerned may challenge that decision before a court under Article 45(9).

Hersteller, die Verbrauchern in der Union Verpackungen oder verpackte Produkte anbieten, stellen dieselben Angaben bei Vertragsschluss auch ihren Fulfilment-Dienstleistern zur Verfügung (Artikel 45 Absatz 7). Fulfilment-Dienstleister bewerten die erhaltenen Angaben nach besten Kräften, etwa durch Abfrage frei zugänglicher amtlicher Datenbanken oder der öffentlich zugänglichen Registrierungsliste nach Artikel 44 Absatz 13; für die Richtigkeit der Angaben bleiben die Hersteller verantwortlich (Artikel 45 Absatz 8). Setzt ein Fulfilment-Dienstleister seine Leistungen aus, kann der betroffene Hersteller die Entscheidung nach Artikel 45 Absatz 9 gerichtlich anfechten.
