Description (English)
Where Articles 24 to 29 are not complied with — excessive packaging, restricted packaging formats, re-use systems, refill and re-use targets — fines must form part of the penalties provided for by the Member States. Where a Member State’s legal system does not provide for fines, the procedure may be initiated by the competent authority and the fine imposed by the national courts; the remedies must have equivalent effect. The Regulation does not set the level.

Bei Nichteinhaltung der Artikel 24 bis 29 — übermäßige Verpackungen, verbotene Verpackungsformate, Wiederverwendungssysteme, Wiederbefüllung und Wiederverwendungsziele — gehören Geldbußen zwingend zu den von den Mitgliedstaaten vorzusehenden Sanktionen. Kennt die Rechtsordnung eines Mitgliedstaats keine Geldbußen, kann das Bußgeldverfahren von der zuständigen Behörde eingeleitet und die Geldbuße von den nationalen Gerichten verhängt werden; die Rechtsbehelfe müssen dieselbe Wirkung haben. Die Höhe legt die Verordnung nicht fest.
