Description (English)
Where formal non-compliance persists — no or incorrectly drawn up EU declaration of conformity, a QR code that does not give access to the required information, technical documentation that is unavailable, incomplete or incorrect, missing economic operator details — the Member State takes all appropriate measures to prohibit the making available of the packaging on the market or to ensure that it is recalled or withdrawn. For the remaining cases listed in Article 62(1), Member States apply the rules on penalties under Article 68.
Description (German)
Besteht eine formale Nichtkonformität fort — fehlende oder fehlerhafte EU-Konformitätserklärung, QR-Code ohne Zugang zu den erforderlichen Informationen, fehlende, unvollständige oder fehlerhafte technische Dokumentation, fehlende Angaben zum Wirtschaftsakteur —, trifft der Mitgliedstaat alle geeigneten Maßnahmen, um die Bereitstellung der Verpackungen auf dem Markt zu untersagen oder ihren Rückruf oder ihre Rücknahme vom Markt zu veranlassen. Bei den übrigen in Artikel 62 Absatz 1 genannten Fällen wenden die Mitgliedstaaten die Sanktionsvorschriften nach Artikel 68 an.
