Description (English)
The technical specifications set out in Annex II apply (Article 21(1)). For recharging points for light-duty vehicles this means in essence: alternating current normal and high-power recharging points erected or refurbished from 8 January 2026 must be equipped at least with Type 2 socket outlets or vehicle connectors under EN IEC 62196-2:2022 — for normal points up to 3,7 kW whose main purpose is Mode 2 recharging, socket outlets under IEC 60884-1:2022 suffice. Direct current normal and high-power points erected or refurbished from the same day must be equipped at least with Combo 2 vehicle connectors of the Combined Charging System under EN IEC 62196-3:2022. Points erected before 8 January 2026 must continue to comply with the earlier version of the standard — EN IEC 62196-2:2017 or EN IEC 62196-3:2014 respectively — until they are refurbished. The requirement therefore reaches three groups one after the other: newly erected points, refurbished points and the unchanged stock. All three groups are covered and differ only in the version of the standard that applies; the obligation is therefore assigned to the rule set covering operators of publicly accessible recharging points. Point 0 of Annex II defines "erected" as the first installation of any relevant recharging point equipment including hardware, software and related electrical infrastructure, and "refurbished" as a substantial or complete replacement of relevant equipment. Annex II also contains specifications for recharging points for L-category vehicles and electric buses, for heavy-duty vehicles, for wireless and dynamic recharging, for the accessibility of recharging stations, for hydrogen, methane, electricity supply in waterborne transport and for fuel labelling. The communication standards of Annex II point 2.1 (vehicle-to-grid communication) are covered by a separate obligation, because point 2.1.3 also reaches private recharging points and therefore needs a rule set of its own. Scope note: points 1.1 and 1.2 of Annex II, unlike point 1.3, do not confine themselves to publicly accessible recharging points, and Article 21(1) states without qualification that the technical specifications in Annex II apply. This obligation is nevertheless assigned to the rule set covering operators of publicly accessible recharging points. Whether the connector standards also bind purely company-internal and depot recharging points is a question of interpretation that has not been decided here. Es gelten die in Anhang II aufgeführten technischen Spezifikationen (Artikel 21 Absatz 1). Für Ladepunkte für Personenkraftwagen und leichte Nutzfahrzeuge bedeutet das im Kern: Ab dem 8. Januar 2026 errichtete oder instand gesetzte Wechselstrom-Normal- und -Schnellladepunkte sind mindestens mit Steckdosen oder Fahrzeugkupplungen des Typs 2 nach EN IEC 62196-2:2022 auszurüsten — bei Normalladepunkten bis 3,7 kW, deren Hauptzweck das Laden in Ladebetriebsart 2 ist, genügen Steckdosen nach IEC 60884-1:2022. Ab demselben Tag errichtete oder instand gesetzte Gleichstrom-Normal- und -Schnellladepunkte sind mindestens mit Combo-2-Fahrzeugkupplungen des Combined Charging System nach EN IEC 62196-3:2022 auszurüsten. Vor dem 8. Januar 2026 errichtete Ladepunkte müssen weiterhin der jeweils früheren Normfassung entsprechen — EN IEC 62196-2:2017 beziehungsweise EN IEC 62196-3:2014 —, bis sie instand gesetzt werden. Damit trifft die Anforderung drei Gruppen nacheinander: neu errichtete Ladepunkte, instand gesetzte Ladepunkte und der unveränderte Bestand. Alle drei Gruppen sind erfasst und unterscheiden sich nur in der anzuwendenden Normfassung; die Pflicht ist deshalb dem Regelwerk der Betreiber öffentlich zugänglicher Ladepunkte zugeordnet. Anhang II Nummer 0 definiert dafür „errichtet“ als erstmalige Einrichtung jeglicher relevanten Ausrüstung einschließlich Hardware, Software und zugehöriger elektrischer Infrastruktur und „instand gesetzt“ als umfangreichen oder vollständigen Ersatz relevanter Ausrüstung. Anhang II enthält daneben Spezifikationen für Ladepunkte für Fahrzeuge der Klasse L und Elektrobusse, für schwere Nutzfahrzeuge, für kabelloses und dynamisches Laden, für die Barrierefreiheit von Ladestationen, für Wasserstoff, Methan, die Stromversorgung im Schiffsverkehr sowie für die Kennzeichnung von Kraftstoffen. Die Kommunikationsnormen des Anhangs II Nummer 2.1 (Vehicle-to-Grid-Kommunikation) sind als eigene Pflicht abgebildet, weil Nummer 2.1.3 auch private Ladepunkte erfasst und deshalb ein eigenes Regelwerk braucht. Hinweis zum Anwendungsbereich: Anhang II Nummern 1.1 und 1.2 beschränken sich — anders als Nummer 1.3 — nicht auf öffentlich zugängliche Ladepunkte, und Artikel 21 Absatz 1 stellt ohne Einschränkung fest, dass die technischen Spezifikationen des Anhangs II gelten. Diese Pflicht ist gleichwohl dem Regelwerk der Betreiber öffentlich zugänglicher Ladepunkte zugeordnet. Ob die Steckernormen auch rein betriebsinterne Mitarbeiter- und Depotladepunkte binden, ist eine Auslegungsfrage und hier nicht entschieden.
