Description (English)
For new buildings the life-cycle global warming potential must be calculated under the Union framework of Annex III and disclosed in the building’s energy performance certificate. The Union framework builds on EN 15978, uses a fixed reference period of 50 years, sets a uniform scope for building components and technical equipment, requires calculation already at the design stage and disclosure of the as-built state, prescribes a hierarchy of input data and requires results for at least each life-cycle stage. The obligation applies to all new buildings from 1 January 2030. For new buildings with more than 1 000 m² of useful floor area it applies from 1 January 2028; that first stage is recorded as a separate obligation. Member States may exempt buildings for which a building permit application was already made before those dates, and the building categories they exempt from the certificate duty. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Für neue Gebäude ist das Lebenszyklus-Treibhauspotenzial nach dem Unionsrahmen des Anhangs III zu berechnen und im Ausweis über die Gesamtenergieeffizienz des Gebäudes offenzulegen. Der Unionsrahmen stützt sich auf EN 15978, setzt einen festen Bezugszeitraum von 50 Jahren an, legt einen einheitlichen Anwendungsbereich für Gebäudekomponenten und technische Ausrüstung fest, verlangt eine Berechnung bereits in der Planungsphase und eine Offenlegung des „As-Built“-Zustands, gibt eine Hierarchie der Eingabedaten vor und schreibt eine Angabe mindestens je Lebenszyklusphase vor. Die Pflicht gilt ab dem 1. Januar 2030 für alle neuen Gebäude. Für neue Gebäude mit einer Nutzfläche von mehr als 1 000 m² gilt sie bereits ab dem 1. Januar 2028; diese erste Stufe ist als eigene Pflicht erfasst. Die Mitgliedstaaten können Gebäude ausnehmen, für die vor diesen Zeitpunkten bereits ein Baugenehmigungsantrag gestellt wurde, sowie Gebäudekategorien, die sie von der Ausweispflicht ausnehmen. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst. Weitere Fundstellen: Artikel 7 Absätze 2 und 4, Anhang III, Artikel 19 Absatz 2 Unterabsatz 2 für bestehende Gebäude der Klasse A+.
