Description (English)
Where an existing building or building unit undergoes a major renovation, its energy performance must be upgraded to meet the minimum energy performance requirements set under Article 5, in so far as this is technically, functionally and economically feasible. The requirements apply to the renovated building or building unit as a whole; in addition or alternatively they may be applied to the renovated building elements. Independently of a major renovation, the same requirement applies to any building element forming part of the building envelope that has a significant impact on its energy performance and is retrofitted or replaced. Article 8(3) is addressed to the Member States alone: on major renovation of buildings they are to encourage high-efficiency alternative systems, in so far as this is technically, functionally and economically feasible, and to take into account indoor environmental quality, climate adaptation, fire safety, seismic risks, removal of hazardous substances including asbestos and accessibility for persons with disabilities. That is an aim set for the Member State, not a separate duty of the owner; what binds the owner are the minimum energy performance requirements under paragraphs 1 and 2. Where a building is renovated to meet a minimum energy performance standard under Article 9, these requirements apply in addition. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Wird ein bestehendes Gebäude oder eine Gebäudeeinheit einer größeren Renovierung unterzogen, ist die Gesamtenergieeffizienz so zu erhöhen, dass die nach Artikel 5 festgelegten Mindestanforderungen erfüllt werden, soweit das technisch, funktionell und wirtschaftlich realisierbar ist. Die Anforderungen gelten für das renovierte Gebäude oder den renovierten Gebäudeteil als Ganzes; zusätzlich oder alternativ können sie auf die renovierten Gebäudekomponenten angewandt werden. Unabhängig von einer größeren Renovierung gilt dieselbe Anforderung für jede Gebäudekomponente, die Teil der Gebäudehülle ist, sich erheblich auf deren Gesamtenergieeffizienz auswirkt und nachträglich eingebaut oder ersetzt wird. Artikel 8 Absatz 3 richtet sich allein an die Mitgliedstaaten: Sie setzen sich bei größerer Renovierung von Gebäuden für hocheffiziente alternative Systeme ein, sofern das technisch, funktionell und wirtschaftlich realisierbar ist, und berücksichtigen die Aspekte Raumklimaqualität, Anpassung an den Klimawandel, Brandschutz, seismische Risiken, Entfernung gefährlicher Stoffe einschließlich Asbest und Zugänglichkeit für Menschen mit Behinderungen. Das ist eine Soll-Vorgabe an den Mitgliedstaat und kein eigener Pflichtinhalt des Eigentümers; verbindlich sind für ihn die Mindestanforderungen nach den Absätzen 1 und 2. Wird ein Gebäude renoviert, um eine Mindestvorgabe nach Artikel 9 zu erfüllen, gelten diese Anforderungen zusätzlich. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
