Description (English)
Each Member State sets, for its stock of non-residential buildings, a maximum energy performance threshold above which 16 % of the national non-residential building stock sits. From 2030 all non-residential buildings must be below that threshold, expressed as a numerical indicator of primary or final energy use in kWh/(m²·a)). Compliance is verified on the basis of the energy performance certificate or by other available means. Member States may set the thresholds for the stock as a whole or by building type and category and may align them with an energy performance class. Where the overall renovation needed to meet the threshold has an unfavourable cost-benefit analysis for a building, at least the individual renovation measures with a favourable analysis must be carried out. Member States may exempt protected monuments and cultural heritage buildings, buildings used for worship and religious activities, temporary buildings with a use of up to two years, industrial sites, workshops and low-energy agricultural buildings, seasonally used residential buildings, stand-alone buildings below 50 m² and defence buildings. Member States must ensure implementation through monitoring mechanisms and penalties. The second step — the 26 % threshold from 2033 — is recorded as a separate obligation. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Jeder Mitgliedstaat legt für seinen Bestand an Nichtwohngebäuden einen maximalen Schwellenwert für die Gesamtenergieeffizienz fest, über dem 16 % des nationalen Nichtwohngebäudebestands liegen. Ab 2030 müssen alle Nichtwohngebäude unterhalb dieses Schwellenwerts liegen; der Wert wird als numerischer Indikator für den Primär- oder Endenergieverbrauch in kWh/(m²·a) ausgedrückt. Die Einhaltung wird anhand des Ausweises über die Gesamtenergieeffizienz oder mit anderen verfügbaren Mitteln überprüft. Die Mitgliedstaaten können die Schwellenwerte für den Bestand als Ganzes oder nach Gebäudetypen und -kategorien festlegen und sie einer Gesamtenergieeffizienzklasse zuordnen. Ist die für die Einhaltung erforderliche Gesamtrenovierung eines Gebäudes wirtschaftlich ungünstig, sind zumindest die Einzelmaßnahmen mit günstiger Kosten-Nutzen-Analyse durchzuführen. Ausgenommen werden können geschützte Baudenkmäler und Gebäude des Kulturerbes, Gebäude für Gottesdienst und religiöse Zwecke, provisorische Gebäude bis zwei Jahre Nutzungsdauer, Industrieanlagen, Werkstätten und landwirtschaftliche Nutzgebäude mit niedrigem Energiebedarf, saisonal genutzte Wohngebäude, frei stehende Gebäude unter 50 m² sowie Verteidigungsgebäude. Die Mitgliedstaaten müssen die Umsetzung durch Überwachungsmechanismen und Sanktionen sicherstellen. Die zweite Stufe — der 26 %-Schwellenwert ab 2033 — ist als eigene Pflicht erfasst. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
