Description (English)
Suitable solar energy installations must be installed on buildings where technically suitable and economically and functionally feasible. In addition, all new buildings must be designed to optimise their solar energy generation potential on the basis of the solar irradiance of the site, so that solar technologies can later be installed cost-effectively. The installations must be in place by 31 December 2026 on all new non-residential buildings with more than 250 m² of useful floor area; the same date applies to all new public buildings. Existing non-residential buildings undergoing a major renovation or a measure requiring a permit, and new residential buildings and new covered car parks, have later dates and are recorded as separate obligations. Existing public buildings must be equipped by the end of 2027, 2028 or 2030 depending on their useful floor area. Member States set national criteria for practical implementation and possible exemptions for certain building types and may use the ground floor area instead of the useful floor area. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Auf Gebäuden sind geeignete Solarenergieanlagen zu errichten, soweit das technisch geeignet sowie wirtschaftlich und funktional realisierbar ist. Außerdem sind alle neuen Gebäude so zu konzipieren, dass ihr Potenzial zur Erzeugung von Solarenergie auf der Grundlage der Sonneneinstrahlung am Standort optimiert wird, um die spätere kosteneffiziente Installation zu ermöglichen. Die Anlagen sind bis zum 31. Dezember 2026 auf allen neuen Nichtwohngebäuden mit einer Gesamtnutzfläche von mehr als 250 m² zu errichten; derselbe Stichtag gilt für alle neuen öffentlichen Gebäude. Bestehende Nichtwohngebäude, die einer größeren Renovierung oder einer genehmigungspflichtigen Maßnahme unterzogen werden, sowie neue Wohngebäude und neue überdachte Parkplätze haben spätere Stichtage und sind als eigene Pflichten erfasst. Bestehende öffentliche Gebäude sind je nach Gesamtnutzfläche bis Ende 2027, 2028 oder 2030 auszustatten. Die Mitgliedstaaten legen national Kriterien für die praktische Umsetzung und mögliche Ausnahmen für bestimmte Gebäudearten fest und können statt der Nutzfläche die Erdgeschossfläche heranziehen. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
