Description (English)
For new non-residential buildings with more than five car parking spaces and for non-residential buildings with more than five car parking spaces undergoing a major renovation, the following must be installed: at least one recharging point for every fifth car parking space, pre-cabling for at least 50 % of the car parking spaces and ducting infrastructure for the remaining spaces, and bicycle parking spaces representing at least 15 % of the average or at least 10 % of the total user capacity. For office buildings, at least one recharging point per two parking spaces must be installed instead. Pre-cabling and ducting must be dimensioned so that the required number of recharging points can be used simultaneously and efficiently. Residential buildings are not covered by this obligation. Article 14(4) sets a lower threshold and a different scope of equipment for them; it is recorded as a separate obligation, “Install recharging and bicycle infrastructure in residential buildings on construction and major renovation”, with the rule set for residential buildings. Exemptions: Member States may exempt certain building categories where the recharging infrastructure would depend on isolated micro-grids or the building lies in an outermost region and the operation of the local energy system would be significantly disturbed, or where the cost of the recharging and ducting installations exceeds 10 % of the total cost of the major renovation; that cost ratio can only be assessed case by case. The bicycle parking requirements may be adapted for building categories not usually accessed by bicycle. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Bei neuen Nichtwohngebäuden mit mehr als fünf Autostellplätzen und bei Nichtwohngebäuden mit mehr als fünf Autostellplätzen, die einer größeren Renovierung unterzogen werden, sind zu errichten: mindestens ein Ladepunkt für jeden fünften Autostellplatz, Vorverkabelung für mindestens 50 % der Autostellplätze und Leitungsinfrastruktur für die übrigen Stellplätze sowie Fahrradstellplätze in Höhe von mindestens 15 % der durchschnittlichen oder mindestens 10 % der gesamten Nutzerkapazität. Bei Bürogebäuden ist abweichend mindestens ein Ladepunkt je zwei Stellplätze zu errichten. Vorverkabelung und Leitungsinfrastruktur sind so zu dimensionieren, dass die vorgeschriebene Zahl von Ladepunkten gleichzeitig und effizient genutzt werden kann. Wohngebäude sind nicht Gegenstand dieser Pflicht. Artikel 14 Absatz 4 stellt für sie eine niedrigere Schwelle und einen anderen Ausstattungsumfang auf; er ist als eigene Pflicht „Lade- und Fahrradinfrastruktur in Wohngebäuden bei Neubau und größerer Renovierung errichten“ mit dem Regelwerk für Wohngebäude erfasst. Ausnahmen: Die Mitgliedstaaten können bestimmte Gebäudekategorien ausnehmen, wenn die Ladeinfrastruktur von isolierten Kleinstnetzen abhinge oder das Gebäude in einem Gebiet in äußerster Randlage liegt und der Betrieb des lokalen Energiesystems erheblich gestört würde, oder wenn die Kosten der Lade- und Leitungsinstallationen mindestens 10 % der Gesamtkosten der größeren Renovierung übersteigen; diese Kostenquote lässt sich nur im Einzelfall beurteilen. Die Anforderungen an die Zahl der Fahrradstellplätze können für Gebäudekategorien angepasst werden, zu denen der Zugang üblicherweise nicht mit Fahrrädern erfolgt. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
