All non-residential buildings with more than 20 car parking spaces must, by 1 January 2027, have at least one recharging point per ten car parking spaces or ducting infrastructure — conduits for electric cables — for at least 50 % of the car parking spaces, so that recharging points can be installed later. In addition, bicycle parking spaces representing at least 15 % of the average or at least 10 % of the total user capacity must be provided, with room for bicycles larger than standard ones. This obligation is recorded separately from the one on new construction and major renovation because it attaches to a fixed date in the existing stock rather than to a building project, and because it has a different parking threshold and a different equipment ratio. For buildings owned or used by public bodies, pre-cabling of at least 50 % of the spaces by 1 January 2033 is added. Member States may postpone implementation until 1 January 2029 for non-residential buildings renovated in the two years before 28 May 2024 to meet national requirements under Article 8(3) of Directive 2010/31/EU. The exemptions in Article 14(5) also apply here. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Alle Nichtwohngebäude mit mehr als 20 Autostellplätzen müssen bis zum 1. Januar 2027 mindestens einen Ladepunkt je zehn Autostellplätze oder eine Leitungsinfrastruktur — Schutzrohre für Elektrokabel — für mindestens 50 % der Autostellplätze haben, um die spätere Errichtung von Ladepunkten zu ermöglichen. Zusätzlich sind Fahrradstellplätze in Höhe von mindestens 15 % der durchschnittlichen oder mindestens 10 % der gesamten Nutzerkapazität bereitzustellen, mit Platz auch für Fahrräder mit größeren Abmessungen. Diese Pflicht ist von der Pflicht bei Neubau und größerer Renovierung getrennt erfasst, weil sie an einen festen Stichtag im Gebäudebestand anknüpft und nicht an ein Bauvorhaben, und weil sie eine andere Stellplatzschwelle und eine andere Ausstattungsquote hat. Für Gebäude im Eigentum oder in der Nutzung öffentlicher Einrichtungen kommt die Vorverkabelung von mindestens 50 % der Stellplätze bis zum 1. Januar 2033 hinzu. Die Mitgliedstaaten können die Umsetzung für Nichtwohngebäude, die in den zwei Jahren vor dem 28. Mai 2024 nach den nationalen Anforderungen zu Artikel 8 Absatz 3 der Richtlinie 2010/31/EU renoviert wurden, bis zum 1. Januar 2029 aufschieben. Die Ausnahmen des Artikels 14 Absatz 5 gelten auch hier. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
