Description (English)
A digital energy performance certificate must be issued for buildings and building units when they are constructed, when they have undergone a major renovation, when they are sold or let to a new tenant, or when a lease is renewed; for existing buildings owned or occupied by public bodies the duty applies without such a trigger. Where a valid certificate issued under Directive 2010/31/EU or under this Directive already exists for the building or building unit, the duty does not apply. On request a paper version must also be issued. The certificate is issued by independent experts on the basis of an on-site visit, which may where applicable be carried out virtually; it must be understandable, easy to read and machine-readable and follow the template in Annex V. From 29 May 2026 it states the energy performance class on a closed A to G scale. It contains recommendations for the cost-optimal or cost-effective improvement of the building, an assessment of whether heating, ventilation, air conditioning and hot water systems can be adapted to more efficient temperature settings, and an assessment of the remaining lifetime of heating and air conditioning systems; for class A buildings the recommendations are not required. Validity does not exceed ten years. For building units the certificate may be based on a common certificate for the whole building or on the assessment of a comparable building unit. Handover variant: where a building is sold or let before construction or a major renovation, Member States may require the seller to provide an assessment of the future energy performance; the certificate is then issued at the latest on completion and must reflect the actual state. Member States may exempt the building categories listed in Article 5(3), points (b), (c) and (e). The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Für Gebäude und Gebäudeteile ist ein digitaler Ausweis über die Gesamtenergieeffizienz ausstellen zu lassen, wenn sie gebaut werden, wenn sie einer größeren Renovierung unterzogen wurden, wenn sie verkauft oder an einen neuen Mieter vermietet werden oder wenn ein Mietvertrag verlängert wird; für bestehende Gebäude im Eigentum oder in der Nutzung öffentlicher Einrichtungen besteht die Pflicht ohne diesen Anlass. Liegt für das Gebäude oder den Gebäudeteil bereits ein gültiger Ausweis nach der Richtlinie 2010/31/EU oder nach dieser Richtlinie vor, entfällt die Pflicht. Auf Antrag ist zusätzlich eine Papierfassung auszustellen. Der Ausweis wird von unabhängigen Sachverständigen auf der Grundlage einer Inaugenscheinnahme am Standort ausgestellt, die gegebenenfalls virtuell erfolgen kann; er muss verständlich, leicht lesbar und maschinenlesbar sein und der Vorlage in Anhang V entsprechen. Ab dem 29. Mai 2026 weist er die Gesamtenergieeffizienzklasse auf einer geschlossenen Skala von A bis G aus. Er enthält Empfehlungen zur kostenoptimalen oder kosteneffizienten Verbesserung, eine Beurteilung der Anpassbarkeit von Heizungs-, Lüftungs-, Klima- und Warmwasseranlagen an effizientere Temperatureinstellungen und eine Bewertung der verbleibenden Lebensdauer von Heizungs- und Klimaanlagen; bei Klasse A entfallen die Empfehlungen. Die Gültigkeitsdauer beträgt höchstens zehn Jahre. Für Gebäudeeinheiten kann der Ausweis auf einem gemeinsamen Ausweis für das gesamte Gebäude oder auf der Bewertung eines vergleichbaren Gebäudeteils beruhen. Übergabevariante: Wird ein Gebäude vor dem Bau oder einer größeren Renovierung verkauft oder vermietet, können die Mitgliedstaaten verlangen, dass der Verkäufer eine Einschätzung der künftigen Gesamtenergieeffizienz zur Verfügung stellt; der Ausweis ist dann spätestens bei Fertigstellung auszustellen und muss den Ist-Zustand widerspiegeln. Die Mitgliedstaaten können die in Artikel 5 Absatz 3 Buchstaben b, c und e genannten Gebäudekategorien ausnehmen. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
