Description (English)
On construction, major renovation, sale or letting of buildings or building units and on renewal of a lease, the energy performance certificate must be presented to the prospective tenant or buyer and handed over to the tenant or buyer. On sale or letting a certificate must exist, and online and offline sale or rental advertisements, including on property search websites, must state the energy performance indicator and the energy performance class given in the certificate. Member States carry out sample checks or other checks to ensure compliance. The permanent display of the certificate under Article 21 is not part of this obligation: it exists continuously and is not triggered by a transaction. It is recorded as a separate obligation, “Display the energy performance certificate in the non-residential building”. The Article applies in accordance with national rules on joint ownership or common ownership; any legal effects of the certificate in litigation follow national law. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Bei Bau, größerer Renovierung, Verkauf oder Vermietung von Gebäuden oder Gebäudeeinheiten und bei der Verlängerung von Mietverträgen ist der Ausweis über die Gesamtenergieeffizienz dem potenziellen Mieter oder Käufer vorzulegen und dem Mieter oder Käufer auszuhändigen. Bei Verkauf oder Vermietung muss ein Ausweis vorliegen, und in online und offline geschalteten Verkaufs- oder Vermietungsanzeigen einschließlich der Webseiten von Immobiliensuchportalen sind der im Ausweis angegebene Indikator der Gesamtenergieeffizienz und die dort angegebene Gesamtenergieeffizienzklasse zu nennen. Die Mitgliedstaaten führen Stichprobenkontrollen oder andere Kontrollen durch, um die Einhaltung sicherzustellen. Der dauerhafte Aushang des Ausweises nach Artikel 21 gehört nicht zu dieser Pflicht: Er besteht fortlaufend und knüpft nicht an einen Vorgang an. Er ist als eigene Pflicht „Ausweis über die Gesamtenergieeffizienz im Nichtwohngebäude aushängen“ erfasst. Der Artikel wird im Einklang mit den nationalen Rechtsvorschriften über gemeinschaftliches Eigentum oder Gesamteigentum angewandt; mögliche Rechtswirkungen des Ausweises in Rechtsstreitigkeiten bestimmen sich nach nationalem Recht. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
