Description (English)
For heating, ventilation and air-conditioning systems whose generators have a rated output above 290 kW a shorter inspection cycle applies: they must be inspected at least every three years. Scope, exemptions and evidence mirror the inspection obligation from 70 kW; only the shorter cycle is recorded here, because one obligation revision can carry only one frequency. The inspection covers the assessment of the generator or generators, the circulation pumps and, where relevant, the components of ventilation systems, air and water distribution systems, hydronic balancing systems and the control system. It also examines the efficiency and sizing of the generators in relation to the building’s demand, the ability of the system to optimise its performance under typical operating conditions and, where relevant, the feasibility of operating it at more efficient temperature settings, together with a basic assessment of the feasibility of reducing on-site fossil fuel use. Exemptions: technical building systems explicitly covered by an agreed energy performance criterion or a contractual arrangement with an agreed level of energy efficiency improvement — such as energy performance contracts — or operated by a utility or network operator and therefore subject to system-side efficiency monitoring are exempt where the overall impact is equivalent. Buildings meeting the criteria of Article 13(10) or (11) are also exempt. Member States may set up separate inspection schemes for residential and non-residential systems and may take equivalent alternative measures instead of inspections. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Further references: Article 23(1) to (7).

Für Heizungs-, Lüftungs- und Klimaanlagen, deren Generatoren eine Nennleistung von mehr als 290 kW haben, gilt ein kürzerer Inspektionsturnus: Sie sind mindestens alle drei Jahre einer Inspektion zu unterziehen. Umfang, Ausnahmen und Nachweis entsprechen der Inspektionspflicht ab 70 kW; erfasst ist hier allein der kürzere Turnus, weil eine Pflichtfassung nur eine Häufigkeit tragen kann. Die Inspektion umfasst die Bewertung des Generators oder der Generatoren, der Umwälzpumpen und gegebenenfalls der Komponenten von Lüftungsanlagen, der Luft- und Wasserverteilungssysteme, der hydraulischen Abgleichssysteme und des Steuerungssystems. Geprüft werden außerdem der Wirkungsgrad und die Dimensionierung der Generatoren im Verhältnis zum Bedarf des Gebäudes, die Fähigkeit der Anlage zur Optimierung unter typischen Betriebsbedingungen und, soweit einschlägig, die Realisierbarkeit eines Betriebs mit effizienteren Temperatureinstellungen sowie eine grundlegende Bewertung der Durchführbarkeit einer Verringerung der Nutzung fossiler Brennstoffe vor Ort. Ausnahmen: Gebäudetechnische Systeme, die ausdrücklich unter ein vereinbartes Kriterium für die Gesamtenergieeffizienz oder eine vertragliche Abmachung mit vereinbartem Niveau der Energieeffizienzverbesserung fallen — etwa Energieleistungsverträge — oder die von einem Versorgungsunternehmen oder einem Netzbetreiber betrieben werden und systemseitigen Effizienzmaßnahmen unterliegen, sind ausgenommen, wenn die Gesamtauswirkungen gleichwertig sind. Ebenfalls ausgenommen sind Gebäude, die die Kriterien des Artikels 13 Absatz 10 oder 11 erfüllen. Die Mitgliedstaaten können getrennte Inspektionssysteme für Wohn- und Nichtwohnanlagen einrichten und anstelle der Inspektion gleichwertige alternative Maßnahmen treffen. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
