Description (English)
After each inspection of a heating, ventilation or air-conditioning system an inspection report must be drawn up. It contains the result of the inspection and recommendations for cost-effective improvements to the energy performance of the inspected system; the recommendations may be based on a comparison with the best available and feasible system and with a system of similar type and include, where relevant, the results of the basic assessment of reducing on-site fossil fuel use. Any safety issues identified during the inspection must be indicated; the author is not liable for identifying or indicating them. The report must be handed over to the owner or tenant of the building or building unit and uploaded to the national building energy performance database. This obligation is recorded separately because a different party performs it: it is addressed to the inspecting expert, not to the operator of the system. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of the independent experts and is therefore recorded as a binding obligation of those experts. Description (German)
Nach jeder Inspektion einer Heizungsanlage, Lüftungsanlage oder Klimaanlage ist ein Inspektionsbericht zu erstellen. Er enthält das Ergebnis der Inspektion sowie Empfehlungen für kosteneffiziente Verbesserungen der Energieeffizienz der kontrollierten Anlage; die Empfehlungen können sich auf einen Vergleich mit der besten verfügbaren und realisierbaren Anlage und mit einer Anlage ähnlicher Bauart stützen und umfassen gegebenenfalls die Ergebnisse der grundlegenden Bewertung zur Verringerung der Nutzung fossiler Brennstoffe vor Ort. Alle bei der Inspektion festgestellten Sicherheitsprobleme sind anzugeben; der Verfasser haftet dafür nicht. Der Bericht ist dem Eigentümer oder dem Mieter des Gebäudes oder der Gebäudeeinheit auszuhändigen und in die nationale Datenbank für die Gesamtenergieeffizienz von Gebäuden hochzuladen. Diese Pflicht ist getrennt erfasst, weil sie einen anderen Verpflichteten trifft: Sie richtet sich an die inspizierende Person, nicht an den Betreiber der Anlage. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der unabhängigen Sachverständigen sicherzustellen, und ist deshalb als verbindliche Pflicht der unabhängigen Sachverständigen erfasst.
