Description (English)
For new residential buildings with more than three car parking spaces and for residential buildings with more than three car parking spaces undergoing a major renovation, pre-cabling must be installed for at least 50 % of the car parking spaces and ducting, namely conduits for electric cables, for the remaining spaces, so that recharging points for electric vehicles, electrically power-assisted cycles and other L-category vehicles can be installed later. At least two bicycle parking spaces must be provided for every residential building unit. New residential buildings with more than three car parking spaces must in addition be equipped with at least one recharging point. The pre-cabling must be dimensioned to enable the simultaneous use of recharging points on all parking spaces. The requirements apply only where the car park is located inside the building and, for major renovations, the renovation measures include the car park or the electrical infrastructure of the building, or where the car park is physically adjacent to the building and the renovation measures include the car park or the electrical infrastructure of the car park. Member States may adjust the number of bicycle parking spaces on the basis of an assessment by local authorities taking account of local characteristics, and may require as many bicycle parking spaces as appropriate where two spaces per dwelling unit are not feasible on major renovation. Recharging points must allow smart and, where applicable, bidirectional charging under Article 14(6). This obligation is recorded separately from the non-residential duty under Article 14(1) because it has a different threshold (more than three instead of more than five car parking spaces) and a different scope of equipment. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. Bei neuen Wohngebäuden mit mehr als drei Autostellplätzen und bei Wohngebäuden mit mehr als drei Autostellplätzen, die einer größeren Renovierung unterzogen werden, ist Vorverkabelung für mindestens 50 % der Autostellplätze und für die übrigen Stellplätze Leitungsinfrastruktur, nämlich Schutzrohre für Elektrokabel, zu installieren, damit später Ladepunkte für Elektrofahrzeuge, elektromotorisch unterstützte Fahrräder und andere Fahrzeuge der Klasse L errichtet werden können. Für jede Wohneinheit sind mindestens zwei Fahrradstellplätze bereitzustellen. Neue Wohngebäude mit mehr als drei Autostellplätzen sind zusätzlich mit mindestens einem Ladepunkt auszustatten. Die Vorverkabelung ist so auszulegen, dass Ladepunkte auf allen Stellplätzen gleichzeitig genutzt werden können. Die Anforderungen gelten nur, wenn der Parkplatz innerhalb des Gebäudes liegt und die Renovierungsmaßnahmen bei größeren Renovierungen den Parkplatz oder die elektrische Infrastruktur des Gebäudes umfassen, oder wenn der Parkplatz an das Gebäude angrenzt und die Renovierungsmaßnahmen den Parkplatz oder dessen elektrische Infrastruktur umfassen. Die Mitgliedstaaten können die Zahl der Fahrradstellplätze nach einer Bewertung der lokalen Behörden an örtliche Gegebenheiten anpassen; ist bei größerer Renovierung die Bereitstellung von zwei Fahrradstellplätzen je Wohneinheit nicht realisierbar, sind so viele Stellplätze wie angemessen vorzusehen. Die Ladepunkte müssen nach Artikel 14 Absatz 6 intelligentes und gegebenenfalls bidirektionales Laden ermöglichen. Diese Pflicht ist getrennt von der Pflicht für Nichtwohngebäude nach Artikel 14 Absatz 1 erfasst, weil sie eine andere Schwelle (mehr als drei statt mehr als fünf Autostellplätze) und einen anderen Ausstattungsumfang hat. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
