In a non-residential building for which an energy performance certificate has been issued under Article 20(1), a certificate must be displayed in a prominent and clearly visible place. The duty depends only on a certificate having been issued, not on the building being open to or frequently visited by the public. Buildings occupied by public bodies and frequently visited by the public are covered by the parallel duty in Article 21(1). There is no obligation to display the recommendations contained in the certificate. The duty exists continuously for as long as a certificate is in force; it is recorded separately from the transaction-triggered disclosure duties under Article 20 because it is not triggered by an event. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of building owners and is therefore recorded as a binding obligation of the owner. In einem Nichtwohngebäude, für das nach Artikel 20 Absatz 1 ein Ausweis über die Gesamtenergieeffizienz ausgestellt wurde, ist ein Ausweis an einer auffälligen und für die Öffentlichkeit gut sichtbaren Stelle anzubringen. Die Pflicht hängt allein davon ab, dass ein Ausweis ausgestellt wurde, nicht davon, ob das Gebäude Publikumsverkehr hat. Gebäude, die von öffentlichen Einrichtungen genutzt werden und starken Publikumsverkehr aufweisen, erfasst die parallele Pflicht des Artikels 21 Absatz 1. Eine Pflicht zum Aushang der im Ausweis enthaltenen Empfehlungen besteht nicht. Die Pflicht besteht dauerhaft, solange ein Ausweis gilt; sie ist getrennt von den an einen Vorgang anknüpfenden Offenlegungspflichten des Artikels 20 erfasst, weil sie nicht durch ein Ereignis ausgelöst wird. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Gebäudeeigentümer sicherzustellen, und ist deshalb als verbindliche Pflicht des Eigentümers erfasst.
