Energy performance certificates, renovation passports, smart readiness indicators and inspection reports for heating, ventilation and air-conditioning systems must be made available to the competent authorities or bodies on request. The request comes from the independent control systems that Member States have to establish for these documents under Article 27(1); those systems check a statistically significant percentage of the documents each year against the criteria of Annex VI. In practice this means keeping the documents to hand and being able to produce them without delay. The Directive is addressed to the Member States; the obligation only binds companies through national transposition law. Its wording requires the Member State to ensure a specific behaviour of the holders of those documents and is therefore recorded as a binding obligation. Ausweise über die Gesamtenergieeffizienz, Renovierungspässe, Intelligenzfähigkeitsindikatoren und Inspektionsberichte für Heizungs-, Lüftungs- und Klimaanlagen sind den zuständigen Behörden oder Stellen auf Aufforderung zur Verfügung zu stellen. Die Aufforderung kommt von den unabhängigen Kontrollsystemen, die die Mitgliedstaaten nach Artikel 27 Absatz 1 für diese Unterlagen einzurichten haben; sie überprüfen jährlich einen statistisch signifikanten Anteil der Unterlagen anhand der Kriterien des Anhangs VI. Praktisch verlangt das, die Unterlagen greifbar zu halten und ohne Verzug vorlegen zu können. Die Richtlinie richtet sich an die Mitgliedstaaten; die Pflicht wirkt gegenüber Unternehmen erst über das nationale Umsetzungsrecht. Der Wortlaut verlangt vom Mitgliedstaat, ein bestimmtes Verhalten der Inhaber dieser Unterlagen sicherzustellen, und ist deshalb als verbindliche Pflicht erfasst.
